Having filed an AoS online, no need to post the AoS.BenjiH23 said:I have been given a Claim Form, with an Issue Date of 27/11/20. Given I received it late as I’ve moved house. I didn’t have much tome to respond, so I have acknowledged the claim today online. I assume I don’t need to post off anything off as well?
With a Claim Issue Date of 27th November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 30th December 2020 to file your Defence. That's three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.6 -
I think that you will be able to produce a strong defence. That sign is designed to stop drivers parking on the car park and not using the shop during the day and thus disadvantaging shoppers who may not be able to park.
The autobank is on the premises which you used and then left straight away.
Honestly you would have to be very unlucky in court to lose this case. I think that VCS have lost the plot.
I would not worry about the CCTV. I doubt that they will have kept it that long.

This is the sign. Also, I would like to add whilst the photo’s were taken by a passing ‘Parking Enforcer’, Tesco does have a cctv camera, but to my knowledge. It is owned by the supermarket, and not VCS. However, my concern is that VCS are able to get access to it.
Tesco have form by using their own staff to take pictures. They have an app which sends the info to the PPC. CCTV at Tesco is for their own security and if required the police. CCTV is not for parking companies and if Tesco passed their info to an unregulated parking company, Tesco have a problem with data protection.
BUT, this will be a traitor against Tesco customers such as a staff member.
I had this with Tesco a couple of years ago, when I claimed it was a scam to their CEO it was cancelled within 24 hrs.
The last Tesco CEO hated customers but there is a new CEO who we hope will understand that customers pays his wages
THE SIGN.
Charges apply 24 hours a day ?
Customer parking only whilst on the premises ... 2 hours limit
You were a customer, you used one of the services offered by Tesco ... the cash machine.
And, as they state charges apply 24 hours a days, this says the car park is open 24 hours a day subject to a 2 hour stay
VCS signs in general are poor and easily beaten in court if they are foolish enough to go that far.

What kind of low life is hanging around that late at night to earn £10.00. What a desperate, sad individual.

Hopefully you have now read the NEWBIES thread and the TEMPLATE DEFENCE thread and realised this is what we do every day? Perfectly do-able.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Have you complained to your MP? Sometimes it works. You never know how far you can go until you go too far.1

I haven’t considered that. I was thinking about writing to Tesco. Just to get their opinion on what counts as a customer. Given I do shop with them regularly, and I do see myself as a regular customer. I figured getting a positive quote from them would help my defence.D_P_Dance said:Have you complained to your MP? Would it be worth doing an SAR when building my defence? I’d like to see their contract for that Tesco, as I feel their sign was very vague and can lead to confusion. 0 -
Always worth submitting a SAR and the information gleaned from it will come in useful at witness statement time. You can only ask for data relating to you and your vehicle. Make sure you attach a scan of your V5C when submitting and sent to the DPO of the PPC.2

You will not see a contract with the landholder until WS stage.A sar will not give it because of course their contract is not your personal data.3
