county court defence: is it okay

So Dpo got back to me regarding my SAR request, they had asked for proof of ID and I have them passport and utility bill. It turns out they have a different surname associated with my PCN(or maybe they made an error) because I’ve never had such a surname, they also say I have an address in Cornwall and but I have never. I’m now concerned that there maybe an identity issue but the dpo is not replying anymore. Please read the conversation
Dpo “Many thanks for coming back to me.That address however doesn’t match. The DVLA have provided us an address in Cornwall and a different surname which you have used in a previous email of White, so neitherWambui or Michael. Can you confirm your Cornish address you were at when the PCN was issued and provide documentation to confirm your surname as White?”Myself : “Hello there must be an error because I’ve never been associated with the name White. Would you please tell me in what context it was used as I am now concerned? Ive also never had address in Cornwall. I did live in Exeter though.”
-This was the last email 4 days ago and I haven’t heard back. On Friday I got a concerning email from the company’s lawyers (bw legal)“Dear Miss xxx
I write in reference to your email dated 06 December 2020.We kindly request that you update us with any address changes when they occur. We note your comments that you have raised a Subject Access Request (SAR) with our client, it is important to note that a SAR does not affect the validity of our client’s Claim meaning that our client has an overriding legitimate interest to recover the sums due to them. As such, your account will not be suspended from further legal action unless we are instructed to do so by our client. A claim was issued on 13 November 2020 and deemed served 18 November 2020. We have not been notified by the court of any issued regarding service of the claim form. As a claim has been issued, if no contact is received within the timeframe specified on the claim in regards to the outstanding balance of £427.46, we will be at liberty to enter a County Court Judgment (CCJ) against you. In order to avoid this you can call us on 0113 487 0430 within 14 days from the date of this email to set up an affordable payment arrangement which is suitable for you. If you do not wish to set up a payment arrangement in regards to the above balance, please respond to the claim form accordingly.”

If you have a received a N1 claim form from Northampton CCBC, you need to submit an AoS (check the NEWBIE) and start preparing your defence. If you have not received a claim form, then BW Legal are up to their tricks again. This was posted about sometime last week when BW Legal threatened someone with all sorts of dire consequences and it tuned out the wasn't actually a live claim form in existence.3

The claim is real, I had a claim form and I returned an acknowledgment of service. I checked with the county court and confirmed they received it. But BW legal were sent me an email saying that I didn’t acknowledge service so essentially I have to pay-but i guess this is just a scare tactic. They are so evil. What was the issue date of the claim form and what date did you submit the AoS? Presumably you know the deadline for submitting your defence and that hasn't passed yet. If you post those date @KeithP will be along to give you the deadline.

I’ve already done all this. I’ve followed all instructions and used the defence template. Everything is on track I believe. Only the SAR that I haven’t gotten the stuff I requested because they wanted to send proof of a surname and address that I’ve never had.I think now I need to check with DVLA why they had “White” associated with me.2 -

So you're now trusting a random person you have no knowledge of with one of the most sensitive pieces of personal information there is on the planet!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

In the first reply you received on this thread I wrote:...you have until 4pm on Wednesday 16th December 2020 to file your Defence.2
