Hi I received a parking fine whilst parked in a disabled bay but didn’t realise I still had to purchase a ticket. I haven’t been a blue badge long. I appealed but they upheld Charge. Should I take this all the way. Thanks

Why would having a blue badge get you free parking?Loraine220663 said:Hi I received a parking fine whilst parked in a disabled bay but didn’t realise I still had to purchase a ticket. I haven’t been a blue badge long. I appealed but they upheld Charge. Should I take this all the way. Thanks1 -
Which parking company ?
As a motorist you must be aware of the importance of reading any signs , if it's a pay on entry or exit car park then pay , or do not use it !! Never assume that parking is always free , it's not1 -
Read the newbies. Do you think that you can beat their lawyer in court? If.so fight, if not pay.You never know how far you can go until you go too far.1

I tend to agree, but if this is a private parking firm, they won't have made that clear at the disabled bays, which is a requirement = they must provide 'adequate notice' of the terms and parking charge and the Code of Practice means there must be signs that can be read without getting out of the car, at accessible bays._shel said:

Private parking is a commodity, just as are Blue Bun and wine gums. Why should one not pay for it?You never know how far you can go until you go too far.1

As above, car parks can charge disabled people to park - but this must be made clear. It will help us to help you if you can supply a little more information, such as:Name of parking company?Whos car park this was ?- most private parking company's infest/occupy other peoples car parks and act for/and their behalfThis means in most cases they ( the parking companies) are agents of the landowner / occupier - so this will help to see if a landowner complaint will helpThere are also a few other important categories, such as Hospital car parks and railway stations. railway stations have by-laws etc attached ( which the parking company's often fall foul of) NHS sites have the NHS parking principles/rules for staff patients and visitors.A few other things that may be of use:Private companies are required to make reasonable adjustments for those with a protected characteristic ( a long winded way of saying disability) this is usually done with the provision of disabled bays which may be wider, on a more level area of the car park, Ground level on a multi story, closer to the entrance etc.A blue badge is only evidence of a disability, if it has expired or is not shown "correctly" or even not displayed at all, the parking company or landowner should cancel any parking charge notice once they are aware that an occupant of the vehicle has a protected characteristic. If you are going to an event where the car park is a grass field, please have your blue badge visible and wind your windows down on entry so you can talk to those running the car parks and they can talk back . in some cases these car parks are run by volunteers, where the event organiser pays a fee which goes towards a charity - if you have no blue badge then a brief and polite explanation will usually help.Sometimes at these events there are no disabled bays ( as there are no bays on a grass field) and you may be parked up in an area or in a method that helps you get in/out of the vehicle - such as the top /bottom of a row on a more level area / with more space around your vehicle etcFrom the Plain Language Commission:

Indeed. Not doing so could open then to a counter-claim for disability discrimination. If they were to lose such a claim it could be very embarrassing for the landowner.

Is that 'Premier Park Limited'? There is a number of parking firms using 'Premier' in their name.Loraine220663 said:Thank you thank you for your comments. The parking charge was issued by Premier Park it local shopping area.Any further help will be gratefully received. Please note, we are not a legal advice forum. Whilst the shopping area might be local to you, and therefore known to you, it probably isn't local to most of the regulars and we still have no idea where this occurred. The place may have cropped up on here before. Someone might know who the landowner is. There might have been other cases at that location on this forum with information that might help.
If a Google camera car drove past it or even entered it, we can have a look for signage or lack thereof.
If you don't tell us where it is though, we can't do any of that.
