Eurocarparks LBC CST LAW

Need advice. Been fighting eurocarparks for nearly two years. Been on the forum and gone through the advised processes, POPLA etc. Now have a LBC. The background is 30p parking not paid, notice served after 11 minute stay, using a car park that is accessed via eurocarparks and waiting with engine running to get a space in the adjacent car park linked to a restaurant that we were visiting.  Argued on the grounds of poor signage as scaffolding was covering entrance signs. Invoice is now at £175. Am I correct that I need to ask for a SAR from Eurocarparks and also request CST LAW send me the details they are claiming for in line with pre-action protocol for debt claims? I have never admitted who was driving nor admitted that I owe the debt. Contact has been minimal and only when required.

Are you sure it's a real LBC and not a debt crawler letter masquerading as one?

There is a group CST Law fightback thread where you will see examples of both and advice on how to deal with them.

CST letters' forum group thread — MoneySavingExpert Forum

If it's a debt collector letter it will tell you they are acting on behalf of a debt collector such as DRP or Zenith or ZZPS who in turn are acting for the PPC.
If it is a true LoC they will be acting on behalf of the PPC.

The former can safely be ignored. For the latter, yes send an SAR as per the NEWBIES, and follow the guide to court written by bargepole that you will find in the second post of the NEWBIES that takes you step by step from the LoC to the court hearing.

What happened when you complained to the landowner?

  • Its definitely a LBC.
I couldn’t find who owned it. It’s a car park not linked to shops.
It’s also common knowledge in the area that the landowners don’t get involved so I didn’t try.

Okay, then it's off to the second post of the NEWBIES to read bargepole guide.
You will need to include proof of ID with your SAR such as a copy of the V5C or two redacted utility bills/bank/card statements.

Get pics of the site and signage, and see if there is anything useful on Google Streetview with regards to the entrance. You can use the time slider to see if there are images either side of the alleged event to prove what the signs looked like at the time.

Deal with it as a LBC as per the NEWBIES FAQ sticky, second post.  We have yet to see any of these materialise into any court proceedings orchestrated by CST. It's believed that it's just a further element of scam by malevolently terming the letter 'LBC'.

Not much else to do but wait to see if you're the first of hundreds who've been hit with these to receive actual court papers. I suspect you'll have a long wait!

On whose behalf do they purport to be acting?  Check carefully what the letter says.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

By now you should have read the CST thread.

CST will have said they have been instructed by DRP ... that is their normal rubbish

This is a so called legal who is clueless about the facts of life
  • This is a section of the CST LAW letter:

We are instructed by Debt Recovery Plus Limited ("DRP"), as the agent of Euro Car Parks Ltd, to begin legal action against you to recover the outstanding amount. We are

informed that you have failed to settle the amount owed or provide a valid reason for non-payment.....

The charge amount includes '15.00 claimed by our Client for the time spent and resource

facilitating the recovery of the charge. The amount is a pre-determined and nominal

contribution to our customer's losses as a direct result of your non-payment.

In the event the outstanding debt is not paid in full, we are instructed to begin legal

proceedings. Our client is satisfied that it has sufficient evidence to support this claim and, if

necessary, will rely on this evidence in Court......

It's best if all posters just stay on the CST Law group thread as we can't keep dealing with tedious CST Law letters, saying the same old stuff again and again because posters think they have a real LBC.
