PCN at Euro Car parts Crawley for parking on DYL

Received the PCN by Premier Park Ltd on 14/11/2020

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.  Also you have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper. 

As the car was legitimately using double yellow lines (temporarily) as intended by the meaning of those road markings, your reply must show me where you have placed signs next to your 'false double yellows' and how they are purported to communicate a completely different meaning than in the Highway code? There are many exemptions for parking or stopping on such markings - as set out in proper (public highway) enforcement - so how are drivers supposed to learn of these unexpected 'Premier Park special' rules if you just paint two yellow lines?

    Is the road the car was parked on private?
    You should take photos of the site and signage in readiness for a PoPLA appeal.

    I have looked up the road on West Sussex County Council's website and it shows the road a Class Q which is Non-maintained road (new estates/private lanes)
    I will get the photos ready for the PoPLA

    What makes the PPC think a car can't stop on double yellow lines?  Of course it can, there are loads of reasons and exemptions to the meaning of those lines and if they are going to mimic Council lines then they must have the same meaning.

    What does the sign say, exactly?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    CM is correct.  If a red light shows on your dash board, it would be wise to stop immediately.  As a BB holder I am allowed to park on some DYLs   

    Complain to your MP, 9 times out of ten these tcikets are scams.
    You never know how far you can go until you go too far.

    There is a thread on here about this same area. I haven't seen it for a couple of weeks but searching might find it.  Some advice was given on that thread.

    please see sign below 
     There nearest sign on the side of the road where I stopped was about 40metres away and there’s one sign opposite to where I stopped and some other small signs along the road which you can possibly read while driving.

    That sign looks to be of a forbidding nature to me. No offer to park, so no consideration, no contract can be formed for a motorist to park.

    There are no signs on the entrance, just signs on the side of the warehouse and on lamp poles which you cannot possibly read while driving unless you stop to read which the signs forbid you to do... 

    I will look into complaining to my MP tonight

    D_P_Dance should I add any of the points suggested in the threads in my first appeal or should I save it for my defence?
