Thanks guys for all your help so far. Just wondering that I'm getting differing advice from you guys on what I should write, should I use my own judgement on if I want to keep in certain parts of the defence/omit?

It's a forum. If you want a single opinion, you need to pay for it. This isn't a legal aid forum , we're trying our best.  It's your decision to take

I'm not sure I can see any differing advice - where's the problem? Please show.

As @nosferatu1001 says, if you're not happy here, maybe best to hire a lawyer, we are a private parking forum, we are not legal aid!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

That is the nature of fora.  Those with a high number of thanks usually agree with each other.  Have you complained to your MP.

Hey guys, I've amended my defence slightly below, let me know what you guys think:

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question and also the driver but liability is denied.

    3.        The Defendant was admitting his mentally ill sister to hospital due to a severe flare up of frenetic, agitated behaviour following the families mother passing away. The Defendant’s sister has prior been diagnosed with Schizoaffective Disorder and needed to be sectioned for her own safety. The Defendant is familiar with the hospital, having used it for over a decade due to different members of his family suffering life threatening mental health conditions, and never experienced a parking charge notice (PCN) here before. The car park has a sign on entry stating “Free Parking”, and “Terms Apply” underneath, but the actual terms are not visible. There is no clear mention that the parking limit is 3 hours.

I complained to my MP that same day via email and letter attached, not received anything back yet and it's been 8 days, is that normal? Not even acknowledgement of receipt.

Also I visited the hospital where I got the ticket and took bunch of pics as advised, such as point of view of the driver. The signs are all over the car park saying it's 3 hours max, arguably in the line of sight where I usually park towards the entrance there isn't any sign. The signs are however heavily faded and don't use alarming colours, instead are blue and white, and as aforementioned faded. You'd have to go right to the sign to make out what it says. Does this hurt my defence?
  • Its entirely up to your MP. Even if it isnt normal, theres not a lot you can do...

Faded signs assist your defence but no photos or evidence is used yet.

agitated behaviour following the families mother passing away.
    should be
agitated behaviour following the family's mother passing away.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
