    Had an update today from PE to tell me they did do a credit reference agency check in march 
     I believe this changes my position a little... Although I still have a very reasonable chance of defence due to being a patron and fellow colleague having their parking charge cancelled by the landowner that same time due to that .
    I have replied to parking eye again asking for a consented set aside on that basis 

    I will now need to update my witness statement I believe. As this is now transferred to the local court assuming I would contact them ? I'm guessing this would still be possible

    No further information provided . I've asked for the evidence, seemed odd to throw this out after over 3 weeks 
  • parking eye are not licenced credit broker , thet dont sell electric , gas insurance or mobile phones , the only way to get info about you would be to do a hard search with the credit referance agency , how would they do this ? , the days of owning equita are long gone , what a shambolic situation

    Yes recieved a without prejudice  email with this on 
  • What else did the email say? We've got half a story so far. Just copy and paste it maybe....

    So if you were at new address, a CRA proper search shows that address. Always. 
    So if they did it and still filed at an old address, then either
    - they did the wring search 
    or
    - they got the right info but ignored it

    hiw does that change your position for anything but the better?

    If it wasn't a genuine attempt at settlement then the label "without prejudice" means little.

    Why would you do a search on someone unless you had "reason to believe" they were no longer residing at the address ?

    If "reason to believe" is established by their own email, how will they evidence the MANDATORY steps in cpr 6.9 (4)(b) when in all likelihood they didn't even attempt it ?
