Amazon knowingly sent damaged goods

Here’s my situation I’ve bought a CD, that’s clearly damaged as it has cracks under the wrapper as seen in the attached picture. I contacted Amazon about the damage saying you could see it was damaged the moment it was picked yet you (Amazon) still sent it out. They “claim” they don’t have anymore of this CD in stock even though a quick search on Amazon proves other wise. I explained the damage and they said I could have a £2.50 gift card that I could use towards a replacement the CD cost £9.99. 
So what are my rights Amazon have knowingly sent me damaged goods yet are expecting me to return the current CD (which I don’t have a problem with) and rebuy the CD using a voucher as part payment

    Nothing, unless the CD is damaged, it's just the case, if it's that important you can buy new ones.

    I may be missing the point here, but Amazon's offer seems quite reasonable.
    What would your preferred option be?
    Having a quick look on Amazon, they don't seem to have it in stock
    My farts hospitalize small children :o
  • Take the money use it towards another CD then cancel your account with Amazon.  That will show them.
  • So they want you to return it, will presumably refund your £9.99 and have given you a £2.50 voucher.

    Why do you want to know your rights?  What more do you want?  Compo?
  • Is the cd broken or only the packaging?
    Over the years I have had several cracked cases with a perfect cd inside.

    You haven't even opened (can see the cellophane) it so you don't know if the Cd is damaged (spoiler, it isn't). £2.50 is generous for a cd case, not that you need one really.

    Nothing about this email interchange says amazon knowingly sent damaged goods. All you are saying is it’s visible damage. They are not anywhere admitting ‘yeah we knew it was damaged but sent it anyway’

    i also imagine the ‘stock’ you speak of is through 3rd party sellers. 

    when you mislead with your title and fabricate information to bolster your story it makes you look ridiculous. Are you young, as these seems like the fuss a child may make over something and may explain things...

    get the refund and your voucher and buy your cd from somewhere else and use your £2.50 Amazon voucher on something else.

    Either the goods are damaged or they're not. It makes absolutely no difference to your rights whether a retailer "knowingly" sent damaged goods, and it's not clear from your post why you're so sure they knew about it anyway.

    Complaining about 2 little cracks and moaning that he was offered £2.50 made him look ridiculous, the rest is just icing on the cake

    It could have been damaged in transit - a knock from something big and sharp in the back of a lorry would easily have given it a crack or two that wouldn't show in the cardboard outer packing - so there's very little chance that they 'knowingly sent out damaged goods' - What exactly are you wanting or expecting? The Queen to pop around with a replacement copy, with a compo cheque for £2500, along with a personal letter of apology from Jeff Bezos? Amazon have made a very fair offer - take it - and move on with life.
