  • in fact that car park is a M+S car park for patrons only , and a max stay of 120 mins , as it is for customers , ie people shopping IN the shop , there is no need for any machines outside , it is also chargable 24 hrs per day , but as the shop is closed in the evening , tickets are not for sale , therefore you cannot park there is a 15 min grace period , built in , this is to allow click and collect customers to pick up 
  • I have attached a copy of the image which was sent in the response from Euro Car Parks.
    Will walk over and take an image of the actual sign to cross check they have not sent me a standard image. Will also take pictures of the machine as they were still covered for some time so it looks like permanent fixture.
    a good clue that its not a generic sign from another location , might be the fact that it states M+S customers , and in rather large type at the bottom "on behalf of M+S site No 1104"

    As above , if the PDT machines are bagged it's not possible to buy 2 hours Parking

    Nothing on that sign about free overnight parking either

    Nothing on that sign about hotel guests

    Nothing on that sign about Tesco shoppers

    Even blue badge holders have no visible concessions

    It's operated on behalf of M & S , so any complaints go to them 

    The hotel has no power to grant parking permission , no legal rights are conferred on that sign to anyone other than M & S

    It's not even possible to obtain more than 2 hours parking , not at any time of the day or night

    I am now beginning to wonder if we are actually being told the full story 

    on first reading the thread I thought this was some hotel many many miles away, where the OP had no knolage or info 

    now unless they have booked back into the same hotel TODAY (hopefully parked elsewhere) , I wonder how they can come out with this statement

    sounds to me like "man in the pub" said free parking on M+S every night after 7pm

    Our local Morrisons had a similar issue a couple of years ago which I posted about on here , with nearby residents parking overnight and getting a PCN ( no pay & display options , 3 hours free parking for customers) and local businesses complaining about the fact that their customers had nowhere to park during the day. ECP had just taken over the parking contract there

    This sounds similar

    There are bar room gossipers that say that ECP switch the cameras off overnight , this is not on any signage on the car park

    the car park is clearly marked as being a M+S carpark , and parking is available during shop hours , the signage CLEARLY states that the max parking allowed is 120 mins , and that the car park is managed 24 hrs per day 

    comments by the OP , and in fact there lask of replys when questioned , are making myself (and others) believe that this was not a hotel car park or car parking incidenrt miles from the OPs home , it was in fact a local car park 

    with that info in mind , what would you advise the OP to complain to there MP about 

    the fact that they have been cought flyparking on one of the mps constituants land 

    this is multiple times your copy/paste has given false and misleading info

    Yes I was a customer at the hotel staying for 5 nights, 2 of which the vehicle was parked in this car park. One i have received a PCN for, the other I haven't which points to the fact the 'charges apply at all times' statement is incorrect.

    That's a bit like speeding - you can drive at 40mph in a 30mph zone for many days without getting caught, but that does not mean it is right to be doing that.

    That's a bit like speeding - you can drive at 40mph in a 30mph zone for many days without getting caught, but that does not mean it is right to be doing that. 

    But it's not quite the same. There is a law which prohibits speeding and every time you drive down the road at 40mph you are breaking the law and committing a criminal offence. The law does not change how ever many times you speed down the road.

    But you are not committing an offence parking on private land. In fact the PCC would argue that you are parking legally and contractually. I would not like to try and argue it, but there could be situations in which the PCC habitually does not charge you for this, that could possibly be interpreted as an implied term to the contract. The speeding law will not change by repeatedly being ignored but the contract terms could.

    It's like if a pub owner gave a friend a free beer for 5 days and then on the 6th day he tried to charge his friend for the 6th pint after it'd been downed.
