Tier 3 travel - settle an argument

    This thread proves the futility of it all. The whole question of 'should we only comply if it's law rather than guidance' seems to be a UK thing rather than being replicated in other countries

    The overall message of 'Stay the !!!!!! at home' doesn't seem to get through and too many are looking for reasons why their circumstances are special and therefore why they deserve a night out with friends/short trip away/travel to another region for dinner or a bit more freedom. 

    Not sure what the answer is but suspect there won't be much positive movement until Easter now unless we have a significant change of behaviors

    Our boundaries are quite clear, but we do have a neighbouring postcode of the next county, this is more of a throwback from when the county of Avon existed I assume?? 
    But sounds like your example is the reverse to ours.

    Go with the local authority administrative boundary, i.e. council.

    It is only in Tier 3 that hotels must close, and only in tier 3 that having an overnight stay out of the home is restricted.  So, the hotels that are open in Tier 1 & 2, require that people take breaks away from the home, otherwise the hotels will be open but empty, which would be absurd.  Especially over the Christmas period when there will not be many business people staying away for work.

    So why isn't it all law then?  Seems reasonable for people to conclude that if some of it law and some of it isn't, then the some of it that isn't is less important.

    There is as yet no law to back it up (as we have not reached 2 December).
    Advice for those in tier 2:
    • you can continue to travel to venues or amenities which are open, but should aim to reduce the number of journeys you make where possible

    • if you live in a tier 2 area, you must continue to follow tier 2 rules when you travel to a tier 1 area. Avoid travel to or overnight stays in tier 3 areas other than where necessary, such as for work, education, youth services, to receive medical treatment, or because of caring responsibilities. You can travel through a tier 3 area as a part of a longer journey

    Advice for those in tier 3:

    • you can continue to travel to venues or amenities which are open, but should aim to reduce the number of journeys you make where possible

    • avoid travelling to other parts of the UK, including for overnight stays other than where necessary, such as for work, education, youth services, to receive medical treatment, or because of caring responsibilities. You can travel through other areas as part of a longer journey

    Where you are in doubt as to which tier you are in, I would suggest that you follow the rules of the highest tier you could be in. Technically, I would assume it goes on council tax local authority.

    On Thursday 26 November the government will announce which areas are in which tier. You will be able to use the postcode checker to find out the restrictions in your area or an area you plan to visit. The NHS COVID-19 app will be updated on 2 December.

    The new rules will come into effect from the beginning of Wednesday 2 December.

    On mine it says XXX council is in X tier, so I think it assumes your postcode and local authority give the same answer, but if they don't, the local authority area is what I think matters.
