In October I bought a new Samsung phone using their £75 trade in scheme. The order was acknowledged, I returned my trade in phone in the pre paid bag supplied and I received an acknowledgement it had been accepted. A courier issue delayed the delivery but that was out of Samsung control. All seemed well, fast forward on 3rd November I found an unauthorised debit on my Amex card for £75 which an email informed me was for failing to send my trade in phone, despite its arrival and acceptance being acknowledged.
To date I have chased this refund, to no avail, I have tried phoning emailing I have an email stating the money would be refunded within 3 - 5 days on 6th November, still no refund.
I have told Amex to query this payment, I spoke yesterday to someone in the UK who said it was to do with sales in Manilla, I know its Manilla i have spoken to a lot of people there trying to sort this out, they offered me a £40 gift card as a gesture of goodwill for all the trouble, i said my time was worth more than that and refused
I do not know how long I have spent trying to sort this out but if I go for an MCOL and they refund it in the meantime can I still proceed with it regardless?

Has the OP received the £75 PLUS the £40 gift card gesture of goodwill?

No the £75 is still un paid/returned the offer was a £40 gift card, which I thought derisory0

If you are still getting the £75 back £40 for having it accidentally being taken out and having to wait is generous.

Honestly, you come across as a money-grabber. You've been offered £40 and you think it's derisory, when it seems you'll get the £75 you're owed anyway.
You think your time is worth more than that, but you're happy to ask other people for their advice, free of charge. Laughable.1 -
This sounds similar to mine. I think some of you are assuming that he is getting the £75 back nice and simple. Which is not the case as he still has not got it.
I have been chasing Samsung since 2nd November for £300 taken from my account. I have spent HOURS on the phone with Manilla and the UK during work hours. UK side are completely absolving themselves of responsibility. Even though this is who the contract is with - Samsung UK.
They have promised on numerous occasions that it has been refunded when it has not.
Citizens Advice told me it was a breach of contract for the initial £300 being taken. Then for each and every subsequent time they promised to refund.
Having a company take money randomly from your account is absolutely not on. £75 to one person could be the difference between having enough food to last the month. I don't think it should be taken lightly and I don't think 20 days (for OP) and 24 days for myself is reasonable when they have taken money illegally.
Citizens Advice have also filed a report with Trading Standards for this.

As for free advice, I thought that is what this site is al about, sharing experiences how to get the best results etc, however if you come up with a really good solution I will donate whatever I get in compensation to a charity

It has been far too long though. I have used all my free minutes speaking to them over the last month and it has been very frustrating. The whole thing has put me off ever buying anything from them again.
When something goes wrong, fair enough. But trying to get it sorted like you have experiences, has been a nightmare.
She promised me that she would try and get some kind of solution as I was supposed to be refunded today (this was the 4th time I was promised). If it is not a suitable solution tomorrow, then I will initiate section 75.1
