It is not pointless - it is to be done for the reasons I said.  You will look like the more honest party in front of the Judge later.

You could cite UKPC v Roger Davey (Google it) as the authority for residents being hounded by a parking firm trespassing in their demised bays.

  • Thanks @Coupon-mad for your patience and advice - I have now sent this off and will see what they come back with
  • They came back rather quick stating:
"We have previously given you our decison regarindg your appeal.

To claim that our warden may have dislodged the permit is quite frankly absurd. Are you suggesting they gained access to your vehicle and then moved the permit? If you really think this has happended we strongly advise you to report the matter to the police.

There is no requirement to have a location number on our signage.

Please note we will not be entering into further correspondence with  you regaridng this matter at this stage."

    Terrible spelling and grammar there.

All I've replied with to that now is:

    "Hello,

I never claimed they gained access to my vehicle. I just fear they possibly may have moved my car enough to possibly dislodge the permit. I was simply stating a fear this may/could have happened but unfortunately, I have no proof. This is the reason I have requested full video footage anyways of the journey to my car as requested in my last email.

Going by your response (with worrying and very unprofessional spelling mistakes) I am assuming you don't have any proof or don't wish to submit it at this time and this has been noted.

Your response with regards to the signage has also been noted as well as the fact you don't wish to further correspond about this matter at this time.

    Regards,
    XXXXXX"
  • One other thing I want to query is when I first appealed, I advised I live at the premises. This is because it was during the November lockdown here in England and I stayed most nights at my girflriend's as we were in a bubble. I put her address in the appeals form as well at the time hoping it would help (before I knew they are unreasonable and don't take anything into consideration).

My normal address and vehicle registration is elsewhere and I'm just wanting to know if this statement when I first appealed could come back to bite me or if it was perfectly reasonable to state this with my appeal? I don't know if this would be seen as lying and wanted to get your thoughts?

Also worried about if they started sending letters to her place now with my name on it or if they will end up doing a NTK instead and I'll get that at my usual address?

Thanks for your help on this query

The question is ... does the boss, that's Rupert of UKPC know his staff is sending out rubbish letters ?    Or, was this Rupert himself ?

The problem UKPC will always have is credibility because his wardens fake pictures which is why Rupert was banned by the DVLA for a month ?

And to quote UKPC ... "To claim that our warden may have dislodged the permit is quite frankly absurd."   .......  is that right UKPC ... so why did your wardens fake the timestamps on pictures ?   On the balance of probability, there is no reason to believe that the warden did NOT rock the car to move the permit. Can the warden prove he did not do this ?

This is like the UKPC utter rubbish that the driver left the site"

So come on UKPC, your wardens popped your cherry with a fraudulent attempt on motorists, don't try this lark on again .... this time it could be fatal

This isn't UKPC but a company called Link Parking just for clarification here
Yes I read the post above regarding UKPC but deleted my post. Please delete the quote.

Even Link have to prove that the warden did not rock the car to move the permit

If it was your main living address on a day to day basis at the time , you were correct in saying that you live there at that time , especially due to covid rules

Some people live in various houses they own or rent over a year , like Billy Connolly did , one in L A , one in Scotland one on Gozo , etc

So where did he live ??   Wherever he was at the time !!

    Where does Boris lve ?

If you want to change the address for service to a more suitable one then email Link, using their data concerns email on their privacy page and tell them to new address and to ERASE (use that word) the old address.  It is vital you don't miss the inevitable court claim from Gladstones.

  • I seem to be getting quite stressed about all this with my anxiety. Really hope I'll win when this goes to court as I only have 4 days left to pay £60 which I'm very tempted to at this stage as it all seems so daunting, stressful and not good for me (I'm now starting to lose sleep over this all).

If it went to court and I lost, what's the most I'd probably pay? I'm trying to weigh my options here as still feel like I don't have much power to defend myself as I'm not the leaseholder as I've stated a few times, and was just a visitor technically.
I'm asking about the worse case scenario cost too because of what their sign says onsite at the private residential estate where this occurred. See below about an extra £60 charge?

If it's going to be hundreds of pounds IF I lost I don't know about all this. If the most I'd have to pay is maybe £100 + court fee it probably won't be so bad then. I've looked around and cannot see examples of how much people have had to pay in any court case losses so wanted to ask if that's OK.
