Coach house issue with carport

  • Check the planning conditions for the site. Permitted development rights may have been removed or a specific condition preventing enclosure of the car port. If that's the case then it can be one for planning enforcement to address.

    but don't leave it too long. Planning can't be enforced after 4 years.

    Sounds like you should never have bought a coach house above 3 car ports. Exactly what harm are these doors doing you, how on earth is it dangerous to your property. If you force through the removal of these doors, prepare for the backlash, not just from the leaseholder but a lot of people take exception to interfering busy bodies. And a car port is open at both ends and it sounds like these have just one opening which is basically a garage without a door.

    Wow what a response!
    How would you like it if a neighbour decides to attach something to your property?
    They have no right to fit doors, the type of property is quite common, some have garages under and some car ports. It's not a decision for the parking space leaseholder to decide.
    Imagine if each party fits different doors - it'll look a mess (and affect the value of the property). It may also impact on the buildings insurance. I guess you think it'd be OK if they brick up the front of their parking space and turn it into a studio flat then?!

    1.When I bought the house I signed a contract to say that no alterations would be made to the front of the building and, in effect, adding a door to the front of the carport has altered the building. Therefore I am in breach of my contract.
    2. They are referred to as carports in the lease
    3. The  lease states that nothing should be done within the carports which could invalidate my insurance. In the event of something happening insurance company could use this as a get out. 
    4.I own the property and I pay for the insurance I receive no contribution from any of the householders. 
    5 I am assuming from your comments then you would be quite happy for somebody to come to your house and make alterations without your consent, knowledge or approval?

    Thank you.  When I first spoke to the householder and asked about the doors she told me she’d had permission from the local council I contacted the council who said that they had neither received nor given consent. I have now gone back to them for proof that Doors were never approved And this has been referred to planning enforcement.

    Even if the council gives them permission they cannot go ahead as it’s your property. Personally I think might be worth while getting it back in your hands, teach them a very expensive lesson for the attitude they have. You have nothing to loose. If the lease is forfeited, the carport is yours. You can rent it back to them £60 a week lol

    Does she know you own  the freehold to the carports? 
    Do you receive the ground rent from the leases for the carports?  Are the conditions in your deeds or in a covenant?
