CCBC defence

After 18 months i am now going to CCBC courtesy of BW legal. I have filed the AOS and am looking at the defence. There is lots of templates to use but in my case there is just a close of photo with the number plate but no longer view showing parking warning and the area of the parking. To my mind they can't prove where it is or that a sign is visible. Do i need all the other reasons if there is no proof of parking wrong doing?

    There is only one template, look again at the sticky threads at the top of the forum - there is ONE.

    To my mind they can't prove where it is or that a sign is visible. Do i need all the other reasons if there is no proof of parking wrong doing?
    They will have other photos. 

    Which PPC?  The Claimant is not BW Legal.

    What was the ISSUE DATE of the N1 claim?

    What date did you do the AOS online?

    As well as answering all the questions above , email a SAR to the DPO at the PPC and attach a copy of the claim form as proof of I D under the GDPR law to obtain all your data , including all pictures and documents

    With a Claim Issue Date of 12th November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 15th December 2020 to file your Defence.
    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

    Don't miss the deadline for filing a Defence.

    Just because they haven't shown you proof of breaching their Ts and Cs doesn't mean they don't have it. They must send you any information they have about you in response to your SAR, but they are not obliged to provide images of the signs or contract until the WS/Exhibits stage.

    Your best bet is always a landowner cancellation so you need to find out who that is and complain to them.

    You also need to get pics of the site and signage sooner rather than later, in the same light conditions as the time of the alleged event. Pics should be distant and close up of the signs and the area where the alleged event occurred, and include any signs that are hidden, high up, or damaged.

  • You are correct Coupon-mad, they did have more photos of where the car was parked. Im not sure why they didnt send the photos in the first place. Attached photos. Any discrepancies to use?

    they can definitely prove where the location is from those pictures

    the embedded metadata within the pictures gives location details as well as other data

    Well the car was parked within a designated bay, so that term was complied with.  Can you argue that the driver was 'authorised' or had reason to believe they were?  There is nothing about displaying a permit or anything, nor to define 'authorised by whom?'.
