Old CCJ advice

I am looking for some advice please.
I split from my ex-partner in 2011 and after I found out he had taken a lot of debt out in my name, around £30,000 and so I opted to go bankrupt and have a clean break. My bankruptcy has now dropped off my credit file as 6 years have passed but I have just applied for a new job and they have found a CCJ in my name but at an address I have never lived at but is known to me as somewhere my ex husband lived when we split and so I assume it's another debt he took out in my name that I was not aware of, this CCJ does not show on my Experian which I pay for monthly but I have found it on TransUnion. I have never had any paperwork relating to this debt and so I don't know what it's for but it's almost £4,000.

The CCJ is dated 27/11/2014 and from what I understand this would be due to be due to clear off my file next week but the job I have been offered have said I would need to provide proof that I have set up a payment plan in order for the job offer to still be valid and the deadline for this is before the 27th. If I speak with the courts and set up a payment plan is this going to 'renew' it somehow and have it show on my credit file for the next 6 years? It would have been included in my bankruptcy had I known about it or I'd have applied to have it set aside. I don't want to raise my head above the parapet unnecessarily but I also don't want to lose the job offer.

    You don't include debts in your bankruptcy.  Once you go bankrupt almost all debts are automatically included in it.  As such, unless it is one of the types of debt that is not included, and the debt (not the CCJ) existed prior to your bankruptcy, you don't need to pay it and arguably shouldn't.

    Is the company aware of your bankruptcy?  If they are I'd just tell them that the debt is included in your bankruptcy (if it indeed pre-dates it) and if you didn't tell them about it and they asked, well, that's probably not a good idea...

The CCJ was issued about a month after I went bankrupt and so the debt will almost certainly pre-date the bankruptcy as he couldn't have gotten me a CCJ in such a short space of time, surely. I know it's about to drop off but due to the start date of the job the deadline for providing the evidence that the debt isn't current is the day before the 6 year mark.

    I suspect you'd need to apply for a set aside to get it removed and that will take time (and cost money.)

    Perhaps it would be better to speak to the court and get confirmation of what the CCJ relates to (and more importantly when)? Armed with this you can then take this back to the company and show them that it is a bankruptcy debt.

    My only concern would be the deadline of the 27th.  I suspect you may not be able to get this done before then.  As such I might just start repaying it, and assuming you get confirmation it predates the bankruptcy, then stop paying it and walk away (although it might be best to tell them why to stop them bothering you further.)

  • set aside on a ccj that is a week short of 6 yrs yes it will cost money , about £255 , and a long long waid (due to covid ) ,, think march / april next yr 

    the job will be long gone , 
    as this is falling off in a few weeks time AND WILL NO LONGER SHOW , forgo this job and look for another one

    Bankrupcy is an all encompassing solution as mentioned above.
    CCJ`s are extinguished under bankrupcy, which means they cannot the chased, and I have to dis-agree with previous advice, you really should not be paying it either.
     It will still show on your credit file for the full 6 years.

    If the job is contingent on paying it (if they can't confirm it's a bankruptcy debt) then why not pay for a month to appease the company and once you know one way or another if you have the job, then stop? Unless your advice is to forget about this job and move on, in which case fine I guess, but perhaps you could just say that.
  • the thing runs out on 27/11 , in 4 hrs it will be the 20/11 , there is about as much chance of finding out WHO the company is , the correct case number , more importantly getting a request into data processing to change address , and setting up a payment plan , ,,,,,,,,,,,,,,, , in effect not much chance with officialdom and effectivly 6 working days 

    unfortunatly the job may have to be forfeitted ,,,,,,,,,,,,,,, unless you can claim 14 days for self file cleaning isolation
