My company had been rumoured to be on the verge of administration for the last month or so, so I was proactive and managed to find a new position with a new company. I rang my boss a couple of weeks ago and informed her of my decision and she was supportive given the company’s uncertain status. She told me to send her my resignation and she would forward it on to HR. I did this and included in my resignation Ietter that I wanted my 4 weeks owed holiday paid and attached a few hundred pounds of unpaid expenses also. In the following two weeks I had no response to say my resignation had been received/accepted, only had an email when furlough was extended to say we’d all been staying on furlough.

Fast forward to last week and the company falls into administration and the administrators issue an email to myself and everyone at head office saying employment has been terminated immediately and to apply for redundancy and unpaid wages/holiday/notice pay via the government’s NI trust.

My question is will there be any problems with me claiming my redundancy, owed holidays, notice pay (I start new job on 23rd, so realise I can only claim 2 weeks notice pay that I’m not in work) as I’d given in my notice? Will the administrators inform the NI fund to only pay me owed holidays and notice pay or am I still due full redundancy as I was in fact made redundant without formal recognition of my resignation.

Thanks for taking the time to read and I appreciate any response.
