I have seen PoPLA appeals won on this alone. It goes against para 14 of the BPA code of practice.

Hi All,

Preparing my WS for remote court hearing on 4th of June. Quick question - the WS linked in the NEWBIES thread pertains to seeing the Claimant's WS? -

Sequence of events "

1.         Firstly, it should be noted that the claimant has appended to their witness statement signage that does not exist at this car park. I have appended the actual signage, photographed myself on November 24th 2019, and will refer to them throughout.

Have not recieved a WS from the Claimant and the advice seems to be send mine 2 weeks before the court hearing - confused how to proceed.

EDIT - know they intend to proceed as called the court last week on the last day they could pay the court fee and was told they paid weeks ago.

For a more recent WS example, look at the one by @jrhys and not the one on the NEWBIES.

The other side has the same WS deadline as you.  It'll arrive tomorrow...I reckon.

Just a quick update on this. I e-mailed my WS yesterday to both the court & BWLegal's sol - this morning, recieved a notice of discontinuance in the post (14 days from the hearing date would have been tomorrow, so guess they did not want to bother doing their WS). Super happy.. but also a bit miffed after spending an age knocking up what I thought was a pretty solid WS!

Massive thank you to all who aided me on this. Special mention to Coupon - thank you keep up the great work.

I did consider claiming costs for a second, but will probably quit while ahead!
