bw legal/Britannia Parking

Today 13.11.20 I’ve received a county court form for parking on private land and not getting a free 30 min ticket. At the time I was with my daughter who has a blue badge. I parked in a disabled bay and read the parking instructions at the car park as I always do about the rules to park with a  blue badge. (I know some car parks aren’t free to park even with a blue badge) I was instructed to park in the correct bay and display the badge. There were no further instructions.
What I didn’t do was read the entire board as I believed that all the information I needed about parking with a blue badge would have been in one place.
I later received a parking fine from Britannia. I rejected the fine and also wrote to POPLA  and sent pictures of all the instructions given with regards to parking with a  blue badge at the car park. This was rejected, and I was told I should have read the entire board as it clearly states that all cars need to get a free 30 min ticket.
I’m sure people without a blue badge wouldn’t be expected to read the instructions for blue badge parking so why am I expected to read the entire board, especially  when I have a child with profound and complex needs that need my undivided attention.
I’m really frustrated as I didn’t try to avoid getting a ticket or park illegally I just don’t think the instructions were clear.
Do I have a leg to stand on, do I have to go to court, do I need to pay the fine of £243.86?
Any plain easy understanding advice, help, guidance  would be gratefully received at this time.

You must tekl Us the issue date as above.

Then you must read the newbies thread about court action. Must. This isn't optional. It will need a good couple hours. If you don't do this you'll waste everyone's time.
This is not a legal aid forum, you're relying on volunteers.

  • Sorry if I’ve come to the wrong place. It’s all quite confusing and I certainly didn’t mean to waste anyone’s time. I find documents and forms so overwhelming.
I’ll try and work my way through the newbies thread and hopefully it will make some sense.
@KeithP the issue date is 09.11.20

With a Claim Issue Date of 9th November, you have until Monday 30th November to file an Acknowledgment of Service. If possible, do not file an AoS before 14th November, but otherwise, there is nothing to be gained by delaying it.
To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an AoS, you have until 4pm on Monday 14th December 2020 to file your Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

You have not come to the wrong place, you just need to read the resources here and use them, as well as asking any questions on this thread as you go through the process.

Any plain easy understanding advice, help, guidance.
This is already in the NEWBIES PLEASE READ THESE FAQS FIRST thread at the top of the forum, second post of it is all about how to win when defending a court claim.  That's why we are pointing you there because we are not repeating it on threads...we can't do it like that.

Any new poster wondering 'do I have a leg to stand on?' is someone who hasn't read the sticky thread yet so we have to signpost you there, first, or we will drown in Groundhog Day threads asking the basics.

This is standard, seen on every thread.  It worries me that you appear not to have read any threads at all yet.

  • Unfortunately not everyone has the ability to retain knowledge in the same way. I did attempt to read the newbies thread, but after hours and struggling to understand it all,  and reading it over and over and forgetting what I’d already read I decided to try and help myself by asking the question directly. Thankfully KeithP was kind enough to point me in the right direction. Please don’t assume that I didn’t attempt to read anything, and perhaps consider yourself lucky that you have the ability to retain knowledge in the way you do. (I’m not annoyed at your comment but just to give you some understanding  this short paragraph has taken me 20 mins to write as I’ve had to re read it so many times)

In which case you're going to need to note take as you go along, or another mechanism to deal. We cannot be a personal service - that's what you pay a lawyer for. We do our best but I fear you'll become too reliant.

Is there anyone who can assist your side?
