    Then add that to the witness statement plus exhibits , a copy of their request to parking Eye

    The more you add in , the more credible you are

    It is not a fine, some here get vey cross when they see that word..  
    You never know how far you can go until you go too far.

    The hearing which was scheduled for September will not go ahead as PE have decided to discontinue the claim following a letter by the district judge asking PE to file a properly completed application and to pay the £25 court fees.

    Wow, they must have dropped the ball and forgotten to pay the court fee in time and got an 'unless' Order?

    Read what we are saying about the false debt recovery proposals which MUST NOT be allowed to get through.  You know your claim didn't include false costs because ParkingEye don't add them?

    Well apparently, the Government have been listening too much to the parking industry since announcing something in March that the PPCs didn't like and ParkingEye started a Judicial Review (it failed).

    But now, the MHCLG want to hand ParkingEye an extra £70 million per annum for sending the exact same letter chain they already send.  What the HECK has happened since March and whose ear have the PPCs been bending?  Clearly someone who doesn't know the background or what the Knight Act is actually for.

    Please give your considered opinion to the Consultation!

    @Coupon-mad - the deadline to pay the court fees and submit a properly completed application was 13th August so PE had time. This request was in the letter sent by the county court regarding the details about the hearing. My guess would be they didn't want to go ahead with the claim as they didn't feel they could win it. Looking back it makes sense as they kept offering me 'discounts' to the settle the matter.

    Sure I'll go through the consultation and add my responses to the questions.

    Very good to hear you will do the Consultation and please give the MHCLG evidence of what happened to you and why parking charges should not be three figures, and certainly not handing ParkingEye the unjustified right to add £70 extra per case.

    Something extra please:
    Please comment on the government consultation concerning parking charges and complain to your MP about the proposal to allow fake add on debt recovery costs.

    I just looked at the POFA Explanatory Notes (part of the legislation):


    221.Paragraph 4 provides that the creditor has a right to recover unpaid parking charges from the keeper of the relevant vehicle if the conditions set out in paragraphs 5611 and 12 are satisfied. The creditor is not obliged to pursue unpaid parking charges through this scheme and may seek to do so through other means but they may not use the scheme provided for here to secure double recovery of unpaid parking charges (paragraph 4(6)), nor will they have the right to pursue the keeper, as opposed to the driver, of the vehicle where they have sufficient details of the driver’s identity. The right to reclaim unpaid parking charges from the vehicle keeper does not apply in cases where the vehicle has been stolen before it was parked, (paragraphs 4(2) to (3)), or in certain circumstances where the vehicle in question was a hire vehicle (paragraph 4(7)). The creditor may not make a claim against the keeper of a vehicle for more than the amount of the unpaid parking related charges as they stood when the notice to the driver was issued (paragraph 4(5)).
