Can CCJ be removed after set aside judgement

Options
Does anyone here have knowledge about this.
Can a CCJ be removed from credit file after it is paid on time (within 7 days) after set aside judgement that confirms the first judgement.
This is different from the first judgement.

If you pay the CCJ in full within 28 days, it will be removed from your credit record. Please be aware that if you pay it more than 28 days after the date of the order, the register will be updated to say that it has been satisfied. However, the CCJ will not be removed.

  • If the judgement was not set aside then paying it off now won't get it removed.  The fact that the judgement has been altered slightly isn't relevant.
  • The judgement was not affirmed at the set aside hearing. If it is now paid within 28 days, will it be removed.
  • if the case has been set aside , then it should no longer appear on your credit file

Do you mean by simply getting a set aside application through with a new hearing without yet going to court should be enough to remove the CCJ.

Basically, if you pay 28 days after the second judgement does it get removed. Because the set aside cancels the first judgement

What stage are you at ?  If the judgement is set aside by the court it will be removed from the register, the proceedings will go back to the claim stage and you start again. Purely applying for a set aside will not remove it from the register and furthermore may not stop enforcement of the original judgement. The court has to decide if it is reasonable to cancel the original judgement. https://www.nationaldebtline.org/EW/factsheets/Pages/howtosetasideacountycourtjudgment/settingasideaccj.aspx

ok you are confusing matters , your topic name says setasides your wording says different

1: you are taken to court and in  your absence you are found guilty , a ccj is issued and this appears on your report

2 you apply for a set aside , this sets things bat to a "not been to court yet" , at this point the ccj is removed , and removed from your file

3 the company can choose to restart court action or not , you can fight or let it ride , they win , you get ccj , you then pay that within 28 days , ccj disappears

    Thanks for this breakdown.

I was in stage 2 however the CCJ was not removed from the credit file.

Now I am I stage 3 where a new judgement has been made and I have to pay the debt.

So the question now is should the CCJ have been removed before the new hearing - stage 2

    If not

Will the CCJ be removed if I now pay within 28 days of the new judgement - stage 3

yes , as this is a new case (setaside killed old one) the ccj issued should be removed if paid witthin 28 days

i the previous case where it was still showing after setaside , that was down to time delay or lazyness

this info is given to the best of my ability , I may be wrong or badly worded , but I believe above to be true

The original CCJ if you have been to court - and was set aside - will be removed - however the updates are usually only sent to the CRA's once a month - and then the CRA's although they update their records fairly quickly - might not show it on your 'free credit report' as that usually only updates once a month as well. If it's still showing on your files after 2 months have passed - then you can chase it up to find out why it's still there.

If you now have a new judgment - that will also be applied to your files - however if you pay in full within 30 days - it will be removed again. So there's a chance that the new judgment may appear temporarily depending on how quickly you pay it off. If you take too long - you'll be back to square one - so make sure you don't dilly dally and get it satisfied asap.
