Gibraltar refund
They have told me I can have a refund of £1690 less £50 per person, for the 3 of us thats
£150, surely I am entitled to a full refund?

Well who did you book with? Did you use an unscrupulous third party who takes admin fees off refunds as per their terms and conditions?0
-
What do their Ts & Cs state? Many travel companies do reserve the right to deduct admin fees from refunds (they do have work to do in such circumstances), although they can't override statutory obligations under the Package Travel Regulations for example.g0bgb said:I have just had my trip for 18th of December cancelled by holiday company,

Why would they cancel a trip that starts after lockdown finishes?I'm a Forum Ambassador on the housing, mortgages & student money saving boards. The airline has cancelled the flight,
Booked a package deal direct with company called Myvacation have them any times before
They cancelled i did not , I would expect the fee if I cancelled
According to this website the Package travel regulations say if they cancel
Refunds should be in full0 -
This website isn't as unequivocal as that, as per https://www.moneysavingexpert.com/news/2020/02/coronavirus-travel-help-and-your-rights/#accordion-content-0406585740-3g0bgb said:The airline has cancelled the flight,

Refunds should be in fullThere are copious references in MyVacations Ts & Cs to their admin charge of £50 per person when refunding but, as above, you could challenge them on it and ultimately take your chances via small claims if you're prepared to make a case that their admin fees contravene statutory rights via an unfair contract term. We've heard from MoneySavers who have had 'cancellation charges' of up to £75 per person taken off their refunds by their travel agent after an airline or package holiday firm has cancelled their trip.
Travel agents' association ABTA says agents ARE allowed to do this, as long as this is included in their T&Cs – though if in doubt, check what you agreed to when you booked.
Yet even if a travel agent does cover this in their terms, the Chartered Trading Standards Institute told us there's a chance it may not be a "fair term", so might not be allowed. It told us it couldn't comment on whether such terms are fair at this stage, or whether holidaymakers can successfully challenge these fees – but if you think a cancellation charge is unfair, contact your travel agent and ask it to justify the fairness of its fees.

As above. You may be successful in a court but may not be for the full £50 per person as agents are entitled to keep some amount for the work they have put in (arranging and cancelling your holiday). Only fair tbh. Up to you to take this course of action as can’t see any other way you can force them into paying the whole lot tbh 🤔0

Well no matter what happens they have lost my custom for ever so sad they have to rip people off
I have been a customer with this company for several years. R.I.P never again0 -
Isn't this a good basis for contacting them and asking them to waive it? If they're truly interested in keeping you as a customer then surely they'd refund you in full. Then you may get your money back and you can still exercise your right not to travel with them again.g0bgb said:Well no matter what happens they have lost my custom for ever so sad they have to rip people off

I've got bookings for work as far ahead as June next year and already I'm receiving cancellations as far ahead as April, appears to be mostly when the airline is removing the destination from their route map. All of these cancellations are smaller airports in Europe, Gibraltar is one of them.silvercar said:Why would they cancel a trip that starts after lockdown finishes?1 -
OK an update, Following "The Package Travel and Linked Travel Arrangements Regulations 2018" companies cannot add terms that override these regulations, and as I did not cancel holiday I'm entitled to a full refund,
I EMAILED THIS INFO TO THE COMPANY also stating my long term custom, and after another phone call to them, They agreed they would give me a Full Refund
Thanks for the info Guys it goes to show stand your ground if you think your right do your homework
And complain
This is second holiday I've had cancelled this year, will book nothing more until things get back k to normal0 -
They just paid it to get rid of you, they’re allowed to add admin charges but dealing with the issue was probably costing them more in time.0
