Nursery fees while shut due to covid

So our nursery shut one "bubble" due to a staff member testing positive to covid and asked that all children self isolate for two weeks in case they develop symptoms.
They have just issued an email stating they have had legal advice that no refunds are to be given as its states in their terms and conditions that "children's absence fees are still to be paid"
Is this right that we don't get a refund? They are the only nursery in the area that still charge even if my child is not ill. Surely I have paid for a service that they cannot provide and therefore under consumer rights I am entitled to a refund?
What if this happens again and again? I'm going to be charged everytime someone in the bubble becomes ill!

    Time to find a new nursery if that is their attitude.

    There's not much you can do it it states in their T's&C's.

    That's the thing, it states if the child is absent, but he's only absent because the nursery is shut 🤷🏼‍♀️

    They can't charge for a service they are not providing.

    That's not technically true. You can't just put anything in your T&Cs and tell your customer tough. Unfair terms can very much be argued and can very well null a contract.

    You are the customer. Find another nursery. 

    From the businesses perspective if there's constant closures short term closures. Financially the business will become unviable. As won't have the reserves to fund fixed costs.

    Find a new nursery. Perhaps also question it on their social media page?
