iParkSmart PCN - Court Claim Form Received
I have a currently outstanding PCN which was issued in October 2019 by iParkSmart / I PARK SERVICES LTD which are a registered IPC member. Originally demanding £100 for overstaying the duration. I Appealed the PCN but never received a letter regarding my appeal or any decision made, nor did I receive a POPLA/IAS number. I have now just received a Claim Form from the County Court Business Centre demanding £247.95
I have read through the guide I believe I am at the point of submitting a SAR to iParkSmart but when attempting to do so, the email address in the privacy policy is incorrect, I am getting a bounceback straight away that the mailbox doesn't exist. Who else should I send this to? Should I send this straight to the contactus email or ask them for the Data Protection Officer and then send it to them?
Thanks All

Nine times out of ten these tickets are scams, so consider complaining to your MP, sometimes it can lead to cancellation.,
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers. On 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and hopefully this will become law shortly

What is the Issue Date on your County Court Claim Form?2

You are correct that they do not even show a DPO e-mail address, wanting you instead to write to: -

Send it to their Contact Us address asking that it be forwarded to their Data Protection Officer.Guy1195 said:I have read through the guide I believe I am at the point of submitting a SAR to iParkSmart but when attempting to do so, the email address in the privacy policy is incorrect, I am getting a bounceback straight away that the mailbox doesn't exist. Do not forget to include some form of identity. Maybe a copy of your Claim Form and/or the vehicle's Registration Document(V5c) if it has your address on it.2 -

I have since sold the Vehicle so maybe I will have to take a picture of the Claim Form, no scanner available at the moment as working from home now too. Do you reckon this would suffice?KeithP said:

Pic of claim form and a utility bill in your name, is what I would send to get a SAR.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If possible, do not file an AoS before 31st October, but otherwise, there is nothing to be gained by delaying it.To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an AoS on 30th October, you have until 4pm on Monday 30th Friday 27th November 2020 to file your Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.2 -
Was this for a parking event at the NFU Mutual premises? If so, do a forum search on keywords 'IPark NFU Mutual' and read other similar cases which might give you some ideas to work from, going forward.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Quality Thanks All. I've submitted the AoS now so will have a look at the Defence template and try cobble something together. Not sure I have a leg to stand on in all honesty, but surely not receiving anything regarding my appeal should be something to note but who knows.0

Why did you do that?Guy1195 said:Quality Thanks All. I've submitted the AoS now...
In my earlier post I wrote:If possible, do not file an AoS before 31st October...As a result you have reduced the time available to you to file a Defence.
I have adjusted my earlier post accordingly.
