    When Initial initially infested Fistral Beach, their NTKs were not PoFA compliant. They must have somebody there with a couple of braincells because within a short period they were banging out PoFA compliant NTKs. Since your brother appears to have one, he, the keeper, can be held liable, so there is no advantage in hiding the driver's identity on this occasion, so editing your first post or contacting a board guide is not necessary.
    Your brother could deal with this himself and try to win at PoPLA or court, or he can choose to transfer liability to you which will reset the clock. The only snag would be if Initial said it's too late to transfer liability (which isn't true) and continue to pursue him as keeper. It's unlikely, but sometimes parking scammers are extremely intransigent and just plain bloody minded.

    If liability is transferred to the driver then the driver should get a NTD through the post and can then appeal or refer to the new BPA CoP version and offer to pay £20.

    Ashby and Johnson, former senior directors (and their spouses) of Smart and hitherto, ParkingEye. Employments seem to have ended with Smart under a bit of a cloud.
