Argos returns policy - 'unopened and unused'

Bought some bathroom scales which I'm not happy with as they have shown significant different weights for me within seconds which might just be a problem with these scales but have caused me to lose confidence in digital scales and I don't want a replacement . Looked at Argos returns policy and it says goods have to be 'unopened' and 'unused'. Obviously I had to open them and use them to find out what they were like, have I lost my rights?

Are you using them on a solid floor?
If they are on a carpeted or other semi-flexible surface, bathroom scales can often exhibit the problem that you describe.2 -
ordered online and collected from Argos store. If I have no confidence in the readings they aren't any good to me. Argos chat said they can't refund because of health and safety0

solid floor (wooden floor boards), I got different weights readings with them in same place

In my experience, the trouble with some of these modern scales is their size. Anyone with reasonably large feet (like me!) finds it impossible to get consistent readings because the weighing platform area is too small. My parents have an older set of mechanical scales which is massive and is consistent.0

that's not an issue, the weighing platform is a good enough size and i have put my feet in the same place each time as much as possible but getting a few lbs difference in seconds gives me no confidence in them

By any chance do you sometimes flap your arms furiously when using them and sometimes don't ?
Sorry, but my only other response was to ask if the floor was carpeted or not - but you have already answered that one.Past caring about first world problems.2 -
