    Hi all,
    My hearing date is set for 3rd week in February.  I have received what i believe is the routine templated letter from Excel Parking looking to extract a settlement with the usual passive aggressive language within.
    My question is, do you recommend, or have you seen success whereby the defendant writes to them offering a Drop hands offer?
    I have the added advantage of being able to cc my commercial landlord into this emailed offer, who would be supportive of them dropping the claim.

    You could offer a "drop hands". It does not do you any harm to show that you don't want to go through the court process. They only make this offer of settlement when they are unlikely to win. They did not offer me a settlement. They are likely to take it to the brink though and pull at the last minute to avoid the costs of representation.

    Their usual MO is to discontinue at the last minute. By offering "drop hands" you are showing that you are prepared to avoid court and not waste court time. After all you have not instigated this claim.

    Excel/VCS tend to make these offers when the claim is weak. They don't make them in every case. That said going to court is still a lottery but it is also a lottery for them especially if the judge has allocated two hours for the case as they will have to pay a rep for two hours even if the case only lasts 10 mins.

    No, not yet.  The letter about the Hearing date arrived with us this week.  In relation to the claim this thread related to, there is more than the (minimum) 14 or 28 days remaining.

    Our household does have a defendant in another claim, for which the letter about the hearing date was dated and received within the 28 days.  The court were telephoned and they advised sending an email in to state that the minimum 28 days for WS could not be complied with, which has been done.  Witness Statement for this one is being created and submitted this weekend based on the newbies thread and template that states "At witness statement stage (usually NOT LATER THAN 14 DAYS BEFORE YOUR HEARING!) don't forget to file the evidence you will rely upon, which should include"

    I will check the paperwork when i'm back in my home office, but from memory there is 30 minutes allocated.  And the District Judge has laid out a list of items required from the Claimant.  Whether that list is in response to my defence or just a template standard they use in these parking matters i am unsure.
