Appeal on Highview Parking Almondvale Retail Park Livingston parking charge notice?

    Thanks for the advise.  I sent an email to Livingston MP asking her help but her assistant replied that I should do the appeal.  So MP is not willing to step in.

    Some Scottish MP,s have more involvement in this matter , be they MSP or MP , some debated it in the House of Commons in the last few years , so responses do vary depending upon who it is , like Pete Wishart for example

    Do the keeper appeal , they may decide it's too hard for Scotland ones and cancel

    My advice in the NEWBIES thread stands, which says do the template appeal. 

    But remove the irrelevant paragraph about pay & display machines obviously, and replace it with the fact there is no keeper liability.  And I beg, DON'T ASK US which box to tick on the Highview appeals page...not again...please...

    Thanks for all the input.  I will do the appeal with following template.  Highview PCN has a website to do the appeal < www.appealpcn.co.uk >, is it the right place to do?

    Re PCN number:
    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    On that website I found below, so does it mean the appeal is not much use?

    POPLA (Parking on Private Land Appeals) is the independent adjudication service offered to motorists who have parked at private car parks in England and Wales. There is currently no POPLA service offered to motorists who park at privately-owned car parks in Scotland.

    You still do the appeal to Highview on their website as keeper , not as driver , double check it's as keeper , using the adapted template , irrespective of any future outcomes

    Don't ask , just do

    Bear in mind no keeper in Scotland can appeal to Popla !! Hence what they say , so no further appeal is possible for a keeper , but that doesn't prevent your appeal to Highview

    I am not telling you to try POPLA; I hope Highview will just fold.  They often do.

    I am not trying POPLA but the website provides by Highview for the appeal is www.appealpcn.co.uk and on the website there is FAQ which has that statement.

    Just appeal as keeper , like we said , no ticking any driver boxes and avoid it reverting to driver at all stages

    You are doing a stage 1 appeal as keeper

    Of course they want people to admit to driving , it makes their job easier

    There will be no second stage appeal for Scotland until next year , too late for this PCN
