STEPS AFTER SAR EVIDENCE

13

Comments

  • Comparing the data received from the SAR to the 'Protection of Freedoms Act 2012' to ensure that all has been fulfilled correctly.

For some of the PCN's, the affixed photos clearly show the car, but show a blurry picture of the 'contractual' parking sign from a distance. In another PCN, the photo of the sign is close up and text is visible. If the blurry sign was disputed, could they just use a photo of the sign from the other PCN where it is visible?

Another PCN also appears to show a white ticket on the dashboard implying payment was made.

Naturally, as @Coupon-mad stated, the £1400 is an unreasonable amount.

Is it sensible to raise this via email with DCB Legal to drop the PCN's/give a reasonable amount?

DCB Legal have amended the amount.
    This all seems very messy.

There is no reason why PPCs photographs should not be crystal clear.  Revert.    .A reasonable amount imo is nothing, nowt, diddly.

Maybe they have removed their spurious debt collection/admin fees.  How did they arrive at the total?  If there are 10 PCNs then 10 x £100 = £1,000 + filing fee, hearing fee and legal costs will get you to £1200.  What is on the letter showing a breakdown of the charges?

They do read this forum , anyone can !!

Or did you think this was a private conversation between friends over encrypted WhatsApp ??
  • @Le_Kirk The update was sent via email; no breakdown was provided. Do you suggest requesting that breakdown?

@Redx Thank you for notifying me. I believe I have removed the information necessary. Let me know if I need to amend anything else. Can yourself and @Le_Kirk please also amend your responses to remove mine?

I was never under the impression this was a private conversation between friends over encrypted WhatsApp.

I’m not quite part of the age bracket that uses WhatsApp to communicate with friends, maybe one day hahaa!

Side note: Eager to take this to court 😊

I would definitely ask for a breakdown but you can work out some of it by checking the PCN and signage charge (say £100 for example) then multiplying it by the number of PCN,s , then checking the fees and charges on MCOL and adding them on plus some interest

I like many people am retired and have many friends and family up to over eighty years of age who use WhatsApp to communicate and even Attenborough used Snapchat recently , never mind the fool POTUS using tweeter daily

But you missed my point , that by stating a system is encrypted , like WhatsApp , the opposite is true about this forum , anyone of over 7 billion people can read it , especially solicitors and parking companies

@Redx Thanks, I’ll do just that.

    I understood your point.

I fear you missed my attempt (perhaps poor) at light-hearted humour, apologies, thanks for keeping me right!

Also, is it appropriate to correspond with DCB Legal via email to drop this or is it a case of creating defence and patiently waiting for the court claim?

    The latter

Dcb legal won't drop this unless their client tells them to !! They take their instructions from their client and with multiple PCN,s at stake there is more chance of a court claim , it's probably inevitable

The stage you are at is gathering Evidence to use later , including the costs breakdown

Sparring with DCBL is like 2 boxers arguing at the pre fight weigh in !!

It's not going to stop them , the heavy stone is already rolling down the hill , gathering speed
  • Ahhh that makes sense - thank you!
