Refund to default account

I have received an email from loveholidays to say my flight refund will be refunded onto a credit card I no longer have access to. I am currently processing a debt relief order in which the credit card is listed. I have tried contacting loveholidays since the flight was cancelled back in April and have not received a response. Is there anything I can do to stop the refund going onto this card as loveholidays have turned off their phone lines and I have tried on every other method available and still no response. I am thinking I've now lost this money but half of it is my sisters which I will need to find to repay her so if there's any way I can get this money back it would be appreciated

    You're repaying some of the debt you owe, what's wrong with that?

    They'll refund the amounts to card from which it was paid.

    It will always be refunded to the card you paid with.

    It will always go to the card paid.

    On our system (operated by a part of Paypal but not PP themselves) it is actually against the merchant account rules to refund to anything else. Similar terms are widespread to prevent abuse.

    That makes perfect sense tbh so only got myself to blame. Thank you for your advice 
  • I don't suppose there would be anything to stop you explaining the circumstances to the CC company and asking them to transfer you half of the refund but under the circumstances (DRO) I'd be very surprised if they agreed.

    It's part of anti-fraud/anti-money-laundering policies to only refund to the same source where possible. If you did use multiple cards they should refund to each.

    If it could be shown that you owed your sister, you could ask, but I highly doubt it, as what puts your sister above all the other creditors you owe and only partially repaying under the DRO. It is the same as those who claim PPI and find a fair chunk of what they are awarded going to pay off defaulted debt associated with the claim.

    You also remember that in the 12 months the DRO is running you have to inform them if you get a big chunk of money.
