Bank chargeback against tattoo school help

So long story short is that partner paid 2 grand for a tattoo course but due to corona had to change dates on us twice and she can’t attend now!

terms and conditions when we booked were 28 cancellation policy with deposit non refundable which we are in as course is now in December  (we paid in full so no deposit) 

Since then new terms and conditions made stating no refunds but I have screenshots on google of the rule saying 28 day cancel policy as google hasn’t updated the search results yet so have proof!

i have submitted a claim with NatWest who will contact me in 10 days! Will they accept the proof I have of it saying 28 day refund policy as I never agreed to the new rules

    Not quite sure what basis they could use for a chargeback in this instance.
    Course is still available. So in effect you are breaking the agreement.
    Long passed the 28 day cancelation period, which might/would have been from when you paid them? (would need to post that term from the T/C to be really clear)
    Non receipt of refund. You would need proof that they have refunded. Date, amount & last 4 of card no. Know that you will not get that.
    Possible misrepresentation, going to require to prove that. But that is a very weak chargeback. Easily got out of by retailer.
    It could well be that you end up taking it to small claim court.

    The 28 day period is Up to 28 days before The course which is now in December so according to the conditions when she paid she should be getting a refund but they changed the conditions in the last month to no refunds which we wouldn’t of agreed to when paying if that was the case

    Also they changed the date to finish on Xmas eve which is totally ridiculous

    Why? Christmas Eve this year falls on a Thursday & is a normal working day.

    It will come down to exactly what the T&Cs of your purchase state - if the cooling off period if 28 days from when you make the purchase, or up to 28 days before the course starts. Either way you'll have to wait for NatWest to make a descision.

    And I agree that 24Dec isn't ridiculous... its a working day just like any other for most of us! You won't get your refund if that's the sole basis of your complaint and you're outside the terms you originally agreed to.

    The basis is that the course should of ended months ago then they changed to a month later then another month now December and the reason it’s ridiculous to me is I have already booked trains to see family from 18th -26th of December 
  • If you have booked a course which was supposed to occur on a certain date and the supplier then changes that date then you are entitled to a refund  - provided of course the terms and conditions do not state that they are able to change the date of the course as and when they wish to

    If they have changed the date of the course and it does not suit your circumstances then you should in the first case apply to them for a refund and if they refuse then you should go to your credit card company

     it is an open and shut case - the course was supposed to apply on date x and now it is date y which is not what you signed up for

    Except no mention from the OP of Credit Card, only bank.
    Also Chargebacks do not cover your consumer rights. They are card regulations that Visa/Mastercard have in place. 
    Sadly not a open & shut case chargeback wise.
    Retailer will contest on the basis it is still available.

  • Yes you are right - for some reason I thought they had paid by card and not bank transfer / cheque.
