Redundancy question

My role went at work and I failed to get another role.
My question is about my last day at work
The email I got said
"This means that you will be given notice that your current post is redundant."
Does this mean that my last day is not the day I got this plus notice period but something else?

I am in a tricky position because my boss wants me to work another month after I finish and I have said yes - but I have not signed anything in writing yet and he hasn't sent anything saying this.
I want to keep my options only sign at the last moment to stay another month because I am interviewing for other roles and if I can get I want to leave ASAP because I am not happy at work and also the sooner I am available for work the better.
Any advice?

How long have you worked there.
  • Over 5 years I am getting voluntary redundancy (to stop us for suing for wrongful dismal).  Obviously I want to get the VR - and I want to be able to say to any other jobs that I can start ASAP.
To be honest I think it is a bit strange that I have to work my notice.  My job has gone and allegedly I am not competent to do the replacement role - so why do they want me to work? I would rather pay incompetent staff off than having them working.

While your role has disappeared is there an element of handover. The VR offer could be dependent upon you working to the agreed termination date.

But presumably they can't mess me around and keep moving it in the future?  For example they couldn't say we want you to leave 1st Feb, then 1st March etc - messing up my ability to get another job without forgoing VR?

Well if they have work for you, then yes they can. It could be a game they are playing, you find a job so have to resign, rather than have a VR payout.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

with a regular redundancy they can mess people about finding other jobs before the termination date.

With VR(mutual termination) you get a contractual payout and termination date that cannot be changed.
Once you have that you have an end date to work to.

How much over statutory is the payout?

The agreed terms need to be made in writing from your employer. These you sign in acceptance. Then there's no dispute.

Thanks for that.  I have been told that my statutory is 3 months after I was told (actually they tried to make it less but as I am getting another month that is no longer needed).
So it looks like it goes to be notice period (3 months) plus 1 month rolling.
However I have not signed anything so I could go back and say I only want 3 months.
I said in an email that I would do it - but is that legal or does it have to be paper.

Statutory notice maxes out at 12 weeks,  3 months would be contractual notice.

Until something is put in front of you you won't know what it is going to be.

You could go back when you have decided when you want me to leave let me know and put me on notice.

In the mean time you have the job for at least the notice period.
