I think there is a chance P/Eye might offer no contest, but I would add this quote from Sir Greg Knight, to your sentence here:I refer you to the new statutory Code of Practice draft that will require at least 10 minutes consideration period plus enough time to leave, if the machines are all broken. Although this is not yet statutory, ParkingEye will be aware from Hansard records recording the journey of the Bill through Parliament, that in February 2018, the Bill’s sponsor, Sir Greg Knight, stated:
‘’If there are a number of payment machines and one of them is not working, that is not an excuse, but if there is only one machine or all the machines are out of order, that ought to be a perfect defence. The company operating the car park has in effect invited the motorist on to the car park to park the car on payment of a fee, and if it is not going to facilitate payment, it should not be able to extract a penalty. Rip-offs from car park cowboys must stop. Most parking operators have nothing to fear from the Bill, but we must stop unscrupulous operators who are undermining the whole sector with their bad practices’’.
I am certain that ParkingEye do not wish to show non-compliance in 2020 with proposals that were in the original Bill two years ago and cannot possibly believe that the bare minimum of 5 minutes can be fairly applied to circumstances where a driver is unexpectedly faced with broken machines, having already spent around 5 minutes driving in, finding a space, parking then walking to the machine, only to find this out and read about the alternatives and then have to leave past the exit camera. This is precisely why the consideration period is a minimum and cannot be rigidly applied.

After a lengthy adjournment due to covid 19, the case regarding my parking fine has been dismissed.
It didn't go to the appeal stage as I received an email from PoPLA stating that PE did not wish to contest the appeal and that I do not need to pay the parking fine.3 -
