    ICO complaints are easy to do online but they are taking months for replies.

    I reported a well known robo-claim firm to the ICO for abuse of my own personal data and refusing a SAR and it's taking many months.  I can wait.

    Anyone can sue anyone, so yes.  Whether you'd win or not is based upon whether you can show loss or severe distress/harassment that is not justified, citing Ferguson v British Gas, etc., and/or you could throw in data misuse, citing Simon Clay v CEL, for example.
