Bought used car from a dealer with a fault!

    If he disputes it and it goes to a hearing he can apply for reasonable costs to attend.
    You also have to pay a £60 fee, but this is added to the debt if you win.

    The more common outcome is you win because he doesn't file a defence but he never pays anything.


    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
  • Based on the problem i have encountered, would it be worth filing a small court claim or waste of time/money would i even win with an oil leak?

    You may find this useful for future purchases.
    Your chances of getting any money back are low. But the small amounts it costs you to go legal could make it worth your while at least trying.

    Are they sure it is not the rocker cover leaking? a cylinder head leak usually is associated with water leaks or engine overheating.

    It was a £950 car. The £300 is the estimated repair costs.

    1969 is before my time, but the choice of <£500 cars is better now than in the 80s...

    It doesnt matter that it was £950, it should still be in a useable condition as a car. I think the OP is within his/her rights to a refund as the fault was obviously present at time of sale.
    BTW £300 was a very good quote for a head gasket; typical garage cost can easily be double that.

    I remember saying to him on the phone how the heck am I supposed to check whats underneath the car? He then said to me we had a ramp next door you could have checked it then but why didnt he just tell me then, i chose to buy from him based on his good reviews on autotrader, could they be forged/faked who knows
