Redundancy looming.

Hello to all and I hope everybody is as well as they can be in these worrying times. 

My question if anybody can help advise..

The company I work for has returned all staff to work bar my own department in the construction industry, we have been advised not to turn down a “safer bet” offer of employment should it arise and that redundancy may become an option they have to consider soon. Myself and my colleagues (we are a small team of 8) have our obvious worries but having none of us ever being through a redundancy before there are questions between us all that nobody knows the correct answers to and it’s becoming more a guessing game.. 

If possible could anybody clarify any of these points please..

1. 90 day notice period is standard, does salary for that period still remain being paid monthly or is it paid all at once ? 

2. Does time served (weeks pay per year) plus holidays get paid at once or on Day 90 ? 

3. Once notice is served if a new job is found and taken for instance a week after notice given, what monies do not get paid then, does the notice money stop but time served and holidays still be paid ? 

4. At which point would a P45 arrive ? 

Many thanks for taking time to read these queries, it’s a horrible time for all, personally I have been furloughed for coming upto 6 months and for myself also having never been through a redundancy it’s concerning, there is no mention of redundancy information in our contracts only the notices to be given by both parties.

  • Start by reading the government guidance at https://www.gov.uk/redundancy-your-rights/redundancy-pay

    You can either be asked to work your 90 day notice period (or remain on furlough while that is available), or be paid in lieu of notice. If you remain working or on furlough, you would be paid on your normal pay dates. You can be asked to take holiday while on notice, whether furloughed or not, provided the requisite notice (usually twice the length of the holiday) is given. Redundancy pay is not due until you have left employment. If you are made redundant and paid in lieu of notice, and then get another job, the payment in lieu of notice is not recovered. If you are originally asked to work your notice period but mutually agree to leave early instead, notice pay would normally stop when you leave.
