So my husband took car finance out with a well known German car dealership two years ago. Within about 5 month of payment they made a massive !!!!!! up unknown to us and settled our agreement in error. My husband doesn't check his bank account so didn't realize payments were not coming out we had a few odd letters from this company which we contacted straight away only to be told they were sent by mistake everything was fine ignore them. Forward a few month we get a call asking us to ring them of which i did. They said they had made a massive !!!!!! up and was really sorry i could make a complaint i was well in my rights. I did this as i wasn't prepared to give them the money they had lost due to there error. It took a while and a few phone calls till i got any response and no sorry came just £100 pound knocked off what we owe and no credit report correction. We are now at the stage after numerous calls and emails they have sent us a default and looking towards a termination with £5000 as they want just under £3000 off us. I contacted ombudsman who are extremely busy and have said we are out of there 6 month criteria which i find strange as my default was 2 months ago. I tried to do a payment plan before i knew the ombudsman wasn't able to help because the car company advised this while the dispute was going on. We offered £50 onto of £299 we already pay they said no they want £465 a month as well as our regular payments of £299 i said you are having a laugh. They want it cleared in 6 months. I am at my whits end there is no reasoning with them and i have already had to go off work last year with stress because of this. I have tryed everything i can sent them an expenditure form proving what they are asking is impossible. I really do not think i owe them anything as they are fully to blame but it comes down to them being a big company who can do what they want. We now have bad credit and was looking to try and change our margage this year but in black and white doesnt look good! Please help !!!!

Even if your husband doesn't check his bank account, where has the total of however many months at £299 gone???1

He spends whatever he has left he pays his bills and whatever is left will go on days out or things as we have a 4 year old.

There is always things that crop up that need paying for or he helps me out as i am self employed so work is up and down. Not that i need to explain where our money goes to anyone. we earn it through hard work and dont scrounge of tax payers0

Whilst I agree the finance house/dealer have made a right mess, I cannot see how your husband couldn't possibly notice he hasn't had £299 a month taken out of his account.1

How can your husband not have realized that the £299 per month wasn't coming out of his account? Crazy.
The fact is though that your husband would have signed an agreement to pay £299 a month over whatever period the finance was and didn't do it so the car finance company I'd imagine are well within their rights to ask for the money owed.
I am insane and have 4 mortgages - total mortgage debt £200k. Target to zero = 10 years! (2030)1 -

If you cannot get a loan for the balance of what you them then you can always sell the car and pay them the money back. Start again with someone who is able to administer your car finance without making a mess of it.2
