  • SORRY one last one, the initial part of the appeal gives these options 
    My vehicle was stolen 
    the contravention did not occur
    the amount specified on the notice is incorrect
    i was not the registered keeper/driver of the car at the type of contravention
    mitigating circumstances prvented me etc etc
    my car was cloned 
    other
    ill be picking the

    That's the way to do it , don't get too deep , keep it simple , because any appeal will be rejected anyway

    The time to fire ammunition is at Popla , to win on a technicality , no keeper liability because apcoa always fail POFA

    I haven't even read your story , because it's irrelevant with apcoa ones

    Apcoa either withdraw at Popla or lose at popla , as long as the driver is not identified , you would think that after 8 years they would comply with POFA , but no

    Appeal each one separately , no matter how many there are , so one at a time

    If bylaws apply , then POFA does not , meaning they have 6 months to issue PCN,s

    Is there any chance I could lose at Popla with no keep liability? also was I right in reading that NTK need to be posted within 14 days of alleged contravention?

    You know what the POFA deadlines are because the NEWBIES thread explains it already.  It's not about when it was posted.

    AND - get ANGRY and GET EVEN about this scam!   Please now make a real difference:

    A TASK FOR SEPTEMBER:

    The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

    You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.  

    And we say the added fake 'debt recovery' costs are just double counting the cost of letters and MUST GO.  Remove that layer and you remove the ‘drivers’ behind the race to court.

    HOW TO DO THE SUBMISSIONS:

    Responses into the PAS 232 and MHCLG framework documents are not completely straightforward:

    On the MHCLG response, you have to answer the questions on a 1-5 scale from strongly agree to strongly disagree, and then put some commentary. No way to upload documents or alternatives.

     

    On the PAS 232, you have to click on each clause and sub-clause to put your comments, and a suggested rewording of their draft.  You can see comments which other people have written! 

     

    But, when you click ‘submit’, a message pops up to say your comments have been received, but that only applies to the particular clause you have just addressed.

     

    You have to click ‘submit’ separately for each individual clause response.

     

    Some people will be caught out by this but can revisit it and add further responses up to 12 October.

    Never say never , we have seen stupid popla decisions , so as long as you crib from apcoa popla appeals over the last 18 months , you should win each and every one , but apcoa have form for throwing in the towel when they see a good appeal anyway

    As I said earlier , if bylaws apply then POFA does not ,whereas you have been reading POFA compliance posts on relevant land

    Read the correct facts for the correct sites

    I mean , remove the pofa restrictions and apcoa had 6 months to issue a PCN from the date of the incident , or where a driver is identified

    You said it's a railway station where bylaws apply , so the 6 months rule applies too , because the POFA law does not apply
  • well i hope popla decide wisely, really dont have the energy for this. im an nhs frontline worker i was hospitalised earlier this year and took months to recover till now. thanks so much guys for your patience apologies for my misunderstandings and stupid questions,
