Bunglebear321 said:Thanks for the help. I've just done some research and I've been slapped with 6 points on my license and £600 fine + fees for not providing info on a driver in December 2019. I moved out in September 2019 and changed my details for everything, insurance, driving license, tax etc but not my V5C foolishly.
I'll have to call the court tomorrow I suppose
It's also why this has happened as well , because it's not just private parking companies that use that data , it's councils and police etc too. I doubt that NPM have anything to do with it , although there may be cases in their name too , letters , LBC,s , court claims etc
This is a direct consequence of failure to update the V5C , plus the fact that you would expect the DVLA to change all details from a data subject , but they don't do that , so that needs complaining about as well. At the moment you have to tell them twice , once for the driving licence , plus once for each V5C as well3 -
An expensive lesson learned

Your cases was nothing to do with npm
You can update v5 and driving licence online so no excuse these days2 -
Thanks all. My initial thought was that it was something to do with NPM but looks like I was wrong. It's one of those things- I changed my driving license + insurance etc but the v5c just slipped my mind completely.
Hopefully they'll be understanding.....

I partly blame the DVLA for causing all this distress, and for not complying with the DPA Principles and updating all records about a data subject who they KNOW has moved.
Honestly, I think someone should report the DVLA to the ICO for this and see what they think.
The DVLA's excuse is that V5Cs are handled by a different Dept than Driving Licences. I think they breach the DPA Principles.

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You can perform a stat dec to state you knew nothing of the offence, get it reset and have a chance to enter a plea. Please not guilty to FtF (otherwise no bloody point doing the SD) and ON THE DAY, IF YOU WERE THE DRIVER, you can ask to "do a deal" - admit to the underlying offence, for which they want to convict you for but cannot, if they agree to drop the FtF
This assumes simple speeding - nothing excessive, no dangerous driving etc.3 -

FtF = Failure to Furnish.
If the RK fails to give out the driver's details, they have to take the rap themselves.
Google Failure to Furnish for more comprehensive answers.3
