Is it legal now to charge and extra fee if choosing to pay with a credit card? If so why does the DVLA still charge £2.50 to pay road tax on line with a CC?

Is the card in question a business credit card? If so then yes they are allowed to charge a fee for using it. If its a non business credit card then no they are not allowed to charge a fee.
Time is a path from the past to the future and back again. The present is the crossroads of both. :cool:3 -
DVLA doesn't charge a fee for personal credit cards.1

Since 13th January 2018 the DVLA has stopped charging for using a consumer credit card when purchasing vehicle tax. However, customers paying by a commercial credit card will continue to be charged a £2.50 processing fee as set in legislation (SI 2017 No.1239). There is no charge for the use of any debit cards.

Hate to be that guy, but there's no such thing as road tax. Road tax was abolished in 1937. The roads are paid for out of general taxation. I think you're referring to vehicle excise duty which is linked to the amount of emissions your vehicle emits.

But jbrassy has a very valid point.
I'm writing a book on plagiarism. It wasn't my idea.1 -

It may seem like semantics, but it's actually entirely relevant. Low emission vehicles pay zero VED. Whenever some moron rants about cyclists not paying any 'road tax' it's helpful to remind them that zero is an entirely appropriate rate based on the CO² emissions.kaMelo said:

The answer to that depends on what type of credit card you are using. The policy on charging £2.50 if paying with a commercial credit card is laid out here - https://www.legislation.gov.uk/uksi/2017/1239/made?view=plain811lly said:Is it legal now to charge and extra fee if choosing to pay with a credit card? Were you using a commercial credit card or a personal credit card?0
