Lots of people have been in the position of not meeting their legal requirement to update the DVLA with both driving licence and V5C details , probably thousands
Few people on here have been through or received the simple procedures system in Scotland , but I suspect we will see a lot more in the future
A SAR should be done asap , with copies of 2 recent redacted utility bills as proof of I D under the GDPR , do not wait for your new V5C to arrive
Find and read the one or two Scotland claims we have had on here in the last 2 years , in case they help you , but don't expect loads of advice about that system , because very few on here know about the topic and it is even rater for those people to come back and update us , or enlighten us either2 -
Changing V5 would not have helped; they cannot ask for your details again from the DVLA, they get them once and once only.2

That's true. If the PCN was already in play and you only moved recently, not changing your V5C would make no difference to ECP, who should have taken other steps to trace you, as proved by the fact Sheriff officers did. However, the point is you MUST do what the forms tell you.i’m not sure if i should do this at this stage? Or wait until they can provide me with a notice with my correct address on?
If the forms were served in person by Sheriff officers, you'd be mad to ignore it and will lose by default.

Thanks i didn’t think the V5 would of made much difference i need to change the V5 regardless, just wasn’t sure how it would stand with my old address on the notice. i plan on requesting a SAR, and go from there. Are these normally requested via email? I will have a look for the other forums for the Scotland cases thank you0

I don't think you'll find much to help you here on this forum, so I wouldn't spend too long searching, there have only been a couple of cases that just fizzled out (from memory). Is yours a single ticket, or multiple ticket case?
Perhaps the LegalBeagles forum will be a better option. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

How to request a SAR and how to find the right email, is fully covered in the NEWBIES thread. The Simple Procedure isn't something we can advise on but there are free Scottish law charities who may help you North of the Border.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Your case won't be about not changing the details , only the DVLA will be interested and could fine you if not done , a separate issue entirely1 -
