    What were you hiring? A Lamborghini Gallardo or Rolls Royce Ghost would have been much less at ABI credit hire rates

    If it was your insurers they’d have passed you to credit hire, the maximum rate under abi credit hire for an M3 is £284.21/day. If it was your broker or the garage I’d be more inclined to believe they passed you to a non-abi provider and many of them charge stupid rates. Did the third party insurers contact you before you got the hire car to offer assistance?

    No wonder they're refusing to pay.

    From what you describe - they deny liability, you refused to use your own insurer because of "an ongoing dispute", and that quite literally incredible hire cost - your day in court is not going to go according to plan.

    Having re-read the initial post you say you are claiming £12k hire plus TL valuation of the vehicle but you never said how much you are claiming for the car only that the salvage is being suggested to be worth £6k which would imply the car itself is being valued near £60k

    Like-for-like hire car is an M3...

    So it's no great surprise there's a fair amount of salvage value present. TBH, a near-new one would, I'd expect, see an even higher salvage value. 10% is just a rule of thumb. Six grand at Copart will get you a 17yo Cat S or id-change... A 3yo Cat N or Cat S is £15-20k.

  • You do realise that as plaintiff the court expects you to do everything possible to mitigate your costs?  If you don't they won't award any more than what they believe is reasonable.  Often even in the case of charging what are reasonable costs, even in the event of winning liability you don't recover full costs.  You recover what the court deems to be reasonable costs.  Your solicitor should have warned you about this at the beginning, but then, they get paid win or lose.

    I know it was an M3 but that doesnt tell me how much they are claiming... if you know the appropriate salvage for that type of vehicle then could backwardly solve for how much their claiming but seems it could be well above the £25k Fast Track limit in which case the risks of litigation become much higher as allowable legal fees increase significantly and there is already £12k on hire costs
