Small claims track = up to 10k
Fast track = between 10-25k
Multi track = Over 25k
All heard in the small claims Court
I've posted an article from MSE above to confirm this.
Thanks3 -
I hope the OP comes back with more info regarding their Court claim and genuinely hope they have/are seeking legal advice as once your over 10k in value it gets costly.0

onlyfoolsandparking said:So what, small claims is just the words people use when talking about Civil Court and making a claim as it's the most common BUT Small claims has DIFFERENT tracks with DIFFERENT limits, what can't you understand about that? I understand about Civil Courts AND Crown Courts, I don't need to search out an article from MSE to confirm that 10k limit is JUST ONE PART of the three available tracks, I highly doubt any Judge will allocate the OP's case to a small claims track when the value is OBVIOUSLY OVER 10k, therefore you posting to the OP to be 'aware' that the limit is 10k IS WRONG!
"So what," indeed.
As per the OP's post stating "small claims" not fast track/etc, so I was correct in highlighting it.
Please do not shout at me as this does not make you right.

Thanks.Just be humble, we all make mistake or give wrong info and should take people correcting us as a positive learning curve.Every single thread that you appear on follows the same trend of incorrect information, arguments and weirdly overly nice things directed at OP’s.Step away from the keyboard Sweetsand, that’s enough warrioring for one day, it’s time for bed.As for the questions on this thread by the OP, we will need more info before being to help or advise fully.3 -
Majik002 said:Hi,
Need help on my Insurance Claim.
I was involved in a car accident last year and the 3rd party admitted fault but insurers wouldn't pay out.
I have now taken this to a small claims court and the 3rd party insurer has made an offer 18months later. The offer is far less then the original claim against the 3rd party. The courtesy/hire car bill was 12k and they've offered to pay £4200. The offer for my vehicle is less than my original claim and they've estimated the salvage value at £6000.
Is it worth me going back and demanding the original claimed amount?
My court date is for December and not sure I want to wait that long but then worried if it goes to court I might get a lower settlement in court. I've never had any experience of this and would appreciate any input.
Thanks
HalIt's up to you whether to take the gamble. In court, they will argue that running up £12k in car hire bills is ridiculous. You should have gone to a car rental place and got a better deal. While they are responsible for paying put genuine losses, you are responsible for keeping those losses to a reasonable minimum. If it sticks, force it.
If it breaks, well it wasn't working right anyway.1 -
Ectophile, I did not want to say that, you said it and I agree 12k is a lot.
Dear OP, another heads up for you but if you are aware already then it may help another/s. Please see link below re fees.
Take care and I hope it goes in your favour

Hi,
Thanks for the input guys.
I have a solicitor who is dealing with the claim but I'm just finding out if there's anything more that can be done.
Small Claim - 10k???
Its a Fast track Claim.
The third party were refusing to accept liabiltity and there was an ongoing dispute with my insurer so I didn't claim. I've got a solicitor who is dealing with my claim and was on recommendation from a friend.
Why is the car hire Bill 12k??
It was a like for like replacement car for 14 days from a company that was referred to me by my insurance company at the time.
Update:
The hire company have now rejected the 1st offer and my solicitor has now contact the third party with a new offer to settle. My solicitor has also asked for my vehicle settlement figure the be 1k more.
I'm hoping the 3rd party accept and pay up as this has been ongoing for some time.
