Fault with car days after sale - Update

  • Thought I would give an update, the car developed a new fault yesterday and is generally not running very well.
I spoke to the manager, who I am now dealing with.
It was too late to take it in yesterday before the garage closed for the weekend.
He wants to get the car booked in or at least with them Monday and is going to try get me a courtesy car over the weekend.
He plans to get them to evaluate/inspect the car, see what the issues are and general car health and said "we will go from there".
He said there is a wide problem of people selling their cars sat around unused over lockdown that are developing faults when used again etc, which makes sense I guess.
I am guessing if the cost of the faults are high, could he ask me to return the car for a refund or refuse the work?
I have had the car now for three weeks and have put on less than 300 miles on the car.
  • Car went in yesterday, the brakes were the first issue, they were worn, full of grime, loose and sticking on/juddery. Had new discs, pads and fittings. They were really bad apparently, which is worrying as they passed them a mere month ago on the MOT.
The second issue they couldn't find on a quick visual check or replicate so they want it back again tomorrow to take it apart and check for loose/broken parts.
The mechanic told me on the quiet that they are likely closing within the next 6-12 weeks but nothing has been announced yet, which is why they had hardly any cars there and staff levels will start to drop.
Pretty sure they are shifting stock before they do so I'm not confident about my car. I'm going to get it looked over by my garage after the latest fix.

    Thank you and ATB.
  • I had a quick scan of the thread but I couldn't see this asked/answered ... how did you pay, and how much? (If you had any finance directly attributed to the purchase then you may have a Section 75 claim route available - a good backup option should the seller fold).

PS - as you've now had 2 faults (i.e. the goods still fail to conform to contract following the seller performing their single allowed repair attempt) then you can exercise your Final Right To Reject the goods for a refund; any refund being allowed to be reduced to account for reduction in value due to your time of ownership.

I would not reject the car at this point. The garage appears to be making efforts to rectify the faults. If you just dump it on their forecourt and post the keys through the letterbox, and they go into liquidation, you may find yourself without a car or a refund.
No free lunch, and no free laptop ;)
  • I paid cash for it via debit card for just under £6k. I will see how they get on with this second attempt at finding and fixing the issue as it is such a generalised clunk/rattle they will need to have a good look at it. Just frustrating to have issues so soon after purchase and it is making me question the car on the whole. I have been up that place 10 times since I bought the car!
  • Car has now developed a new steering issue after being fixed for the first issue. It is also now booked in for the clunk issue in a few weeks. I really have had enough of things going wrong on this car now!
  • Hmm. 6k to me isn't loose change for a car, being someone who usually spends in the 1k-2k bracket.

My cars get labelled bargain basement on here (to me, bargain basement is about 300-600 but each to their own opinion) and that you should spend more to have something that shouldn't be riddled with problems.

I wonder where these people sit on a 6k outlay?? Should you expect trouble with that money or not? I would expect a really nice car trouble free for that.

Obviously depends on what you're buying. I'd expect a bit of a difference between say 6k on a Mitsubisbi Evo and a Ford Fiesta.
  • It was indeed a Ford Fiesta lol. Yeah I bought this to last as it has low milage so was hoping for a good few years or so out of it.
I'm giving them a chance to fix the issue and if not I will try and reject it. Either way I don't see me keeping it passed a year now unless things stop breaking.
