New tyre goes flat after less than 24 hours

I replaced a tyre yesterday that I was told was required to be changed.  TBH in my opinion it had a few months of light use left on it as the tread wasnt below or at the depth market.
But ok.
Bought a part worn tyre, they fitted it... put it in the water tank etc...
Drove straight home 2 min drive, parked up.
next morning was about to set off drive, noticed weird steering and noise.  car wasnt moving forward, got out noticed the tyre was flat.
but not just low pressure but like completely flat and part of it had come off the alloy
Having spoken to the guy that fitted it, he seemed to be very defensive, explaining that i should not be blaming them, and that I must have hit a kerb or drove over a nail.
As I could not take the nuts off cos they put them on so tight, I asked that they send someone to help take wheel off, first they said yes ok we will try, then they decided to charge £50 call out charge to remove the tyre.  And then charge again to fit another part work tyre.
While on the phone he said another tyre he fitted on the car had a nail in it but he took it out before fitting it.....great!
Whats the legal standing on this....
Are they free of any responsibilty on this?

    Sorry to hear about that.
    Bad news I'm afraid. Used tyre appeared to be good when they fitted, you drove home and you could have damaged it, picked up a nail,etc. Therefore, put it down to a bad experience.

    About him saying he took the nail out of it - you need to have proof and I'm a bit puzzled by that statement.

  • I wouldn't touch part worn tyres. better off going for a budget or mid range brand new. with part worn you have to ask why were they removed from the other vehicle?.

    Agreed as OP may be pleasantly surprised at the online prices of budget or the more expensive tyres.

    i mainly go for part worn ads i have low mileage per year and local use, usually they are ok.

    I get that you dont know where these tyres have come from or how they been stored, but you have to assume the garage has quality control in place

    Are they marked "PART WORN", as the law requires?

    Because if they're skimping on that, which other of the legal requirements are they skimping on?
  • How well do you know the tyre place? not very well I'm assuming from your statement of them charging you a call out fee? ,I've never had any problems with part worns but then again I have been using the same place for years, I wouldn't put a part worn tyre on from any place I'm not familiar with, they do carry a certain risk.
  • its the only contact your car has with the road. and I for one do not want somebody else's cast off fitted on my car.

    Do they mention 'part worn' on the side as the other poster here said and if not, then they are not legal.

    As another poster said, go for budget tyres new ones. We had a puncture on our S class, thankfully a clow puncture, got us home noted the next day. Compared to the local, well know tyre fitters we got someone to come around our place and fit it for almost 70 quid less.

    There's not much money in part worn tyres and whilst they do have responsibilities to you as a customer if they have no customer service when you complain there's not a lot you can do about it.

    Avoid them and buy some new cheapest mid range tyres instead.
