PARKSHIELD COLLECTION LTD - a new low

This is an odd one so I've put this here as not sure where else to put it.

I've have a YouTube channel that deals with various IT stuff. I mainly use it for my IT notes. I do a bit of IT Security, mainly as a hobby. I came across Parking Enforcement Agency for some reason, I can't remember why and had a look at their site. Most of these parking enforcement sites tend to be really poor security wise. Their site was one of the worst at the time of the video, 6th August 2019. For the appeals process they required you to fill in their online form. Because the whole site, including the form was HTTP, everything was being sent over the network in plain text. It was possible to intercept the traffic from the site using Fiddler and even pause a form from being sent so that you could edit any details in that form, before allowing the form to resume its way to PEA. You'd have no idea this had happened, you'd assume the form was sent with the correct details but any malicious person on the network could alter it.
Their site had no e-mail information to inform them of these issues and no information at all regarding GDPR.

So I made a video showing me filling in the form with Fiddler incepting the traffic and relevant information that was in the form. I then placed this on my YouTube channel. Its only had 44 views, all video footage created was my own work but it appears Andrew Palmer (who I believe is actually Andrew Fitton but he's possibly given YouTube a false name) has claimed the work as his copyright and the video as been given a copyright strike.

For anyone who doesn't know YouTube, a channel can only have 3 strikes and then their account is deleted. If a video is flagged and you make money from the channel (I don't as monetisation is off), the claimant can claim the money. In the above case he has claimed it so the video is instantly removed (he clearly doesn't know how the Internet works as it still appears on my lbry account which is a decentralised alternative to YouTube to stop censorship such as this).

I'm unsure where to turn. I'm in the process with YouTube in the first step, where I have to contact the person who made the false claim to request they remove the claim and strike. I've e-mailed Andrew as he gave his business e-mail address to YouTube, I've used my GSuite account so I can trace the e-mail to their server to make sure it doesn't get rejected. Failing that I either have to wait 90 days for the strike to expire and be removed or I take it further with a counter claim which could lead to court. But at that point I have to give my full name and full address at which point the false claimant could use said details to then abuse you further.

Anyone else had dealings with this company? I also had put in the description how does one become a director of a company and then resign the same day as Mr Andrew Fitton did in 2009 with Consolidate Me limited.

  • I forgot to add, all he had to do was e-mail the e-mail account on the YouTube account and request the video be removed. Not because its his own work, its not, but because they've finally updated their site to have SSL and GDPR info is finally up.

    I have to worry because it now limits the YouTube account until the 90 days are up or I go for a legal appeal.
  • Go for the counter notice route and require them to prove they own the copyright. Given they stated under penalty of perjury that they do
  • Problem there is I then have to give my full name, my real address and phone number, which, he can then use to abuse me other ways. If he doesn't reply by sometime next week I think I will. I shouldn't have to wait 90 days and do a Copyright School course (which YouTube requires) when I'm not in the wrong.

    I've e-mailed a few news agencies to see if they are interested in his abuse.

    I would of removed the video if he'd e-mailed me as the main site is sorted SSL wise, however their main business website is still insecure and still in breach of GDPR. Reporting to the ICO is pointless as they always say "Speak to the individual first". The ICO only appear interested if the company is massive.
  • Had another look and to let it expire in 90 days you have to do their online Copyright School. Why should I when its a false claim.

    Why not report your concerns to the Information Commissioner?    Drop them in it.

    The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

    You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.  

    And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

    Nine times out of ten these tickets are scams, so mororists ticketed should consider complaining to their your MP. as Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,


    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Nothing stopping me but I shouldn't have to. It's taken me 9 years to build it up and get the subs I have. We do, thankfully, have the likes of lbry which is a decentrialised system so everyone has access to any video because it gets shared in a P2P way. It stops people such as this hiding their crimes. They clearly don't understand "The Internet never forgets".
    Luckily I'd signed up to lbry a while ago so all videos are backed up there.

    Granted, that site now has an SSL cert but for months it didn't. Doesn't take away from the fact their main site, ParkShield still doesn't and is still exposed.

    I've never had any luck reporting to the ICO. They've never been interested and also said "Speak to the company first".

    I've checked the e-mail I sent the other day via GSuite admin and can see it arrived at their servers just fine. If their website is that bad, how are they storing all the GDPR info? Insecurely is my bet.
