Parkingeye warrington bank quay 6 months late

hello, i am just wondering the best way to dispute this fine, i have read the main threads but find them very confusing.

My partner entered a car park caught by the camera systems on 6th March and left 6 minutes later. He entered to look at the prices and to do so had to pull in to a space, he left after seeing how expensive it was caught again by the camera .
We have now just recieved the notice on 10th september after they sent it to the wrong address origionally (old address even though it was updated with DVLA in december last year) and then used a credit reference agency to get our new address. The amount for £100 but said since it was a wrong address the first time they were giving us good grace and allowing is 14 days to pay £60 before it goes up.

How can we dispute this?

    It is not a fine.

    Have you checked that the DVLA had the correct details for the keeper's previous address?
    Have you checked with the DVLA when precisely they updated the V5C details?
    Have you asked the DVLA who applied for the keeper's data and when from a date before the alleged event until now?

    Do you know if the original NTK was PoFA compliant? If not, send an SAR as per the NEWBIES asking for all personal data they hold on the keeper. Include a copy of the current V5C and PCN number as proof of ID. This should flush out the original PCN.

    Check what the current version of the BPA CoP says about grace periods.

    Send the appeal template in blue from the first post of the NEWBIES. There is nothing stopping the keeper doing this and adding a one liner that since the NTK has only just been served, they must allow 28 days for you to appeal.

    I bet the address update was only given to the DVLA for the driving licence, not the V5C (logbook). There has to be two separate notifications. 

    This is easy to win though, the grace period now is 5 minutes.
    But they were there for 6 minutes. The PPCs will all be making hay now the BPA have introduced a ridiculous 5 minute grace period at the commencement of parking. It's a 'minimum of 5 minutes', but few PPCs will miss the opportunity to ignore 'minimum'!

    PE's signage leaves much to be desired, so much so that nmay judges are dismissing claims  becsause of oit, read this,

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    All the OP needs to do is understand that this is a non-POFA PCN and to tell P/Eye he/she knows that! 

     Without saying who was driving, of course.  But we have to work on the assumption that all newbies know that from reading the NEWBIES PLEASE READ THESE FAQS FIRST thread, first.
