Coupon-mad said:Change 8(2)f to 9(2)f each time (POFA paragraph 8 is wrong for a postal notice). I saw that 3 times.
And you said this: ''the relevant NTK was not served within the relevant period'' but you haven't walked POPLA through the dates, which I would do because their assessors are not good at understanding the POFA. The NTK had to reach your house by DAY 14. Spell out the dates to POPLA.
The rest of it is fine!
So the intial PCN was a windscreen notice and so I thought the NTK should reach with day 56?
and in this case wouldn't it be para 8 and not 9?
thanks0 -
Oh, are you the rare one with a windscreen PCN from P/Eye?!
OK so you are right.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all,
So after 3 weeks Parking Eye have finally submitted their evidence. they have submitted a 60 page document with things like a redacted copy of their agreement with MRI and the whole case details, with their photographs of signage etc. In the case history i've noticed that they have put "xx/08/2020 -Letter Issued - Driver Details Required non POFA with FAQ’s Non-POFA" Does this make my appeal stronger?
POPLA have asked me to provide comments before the 14th. I've never had it reach this far so I'm not really sure what I should write in the comments? Any suggestions0 -
Point out that even P/Eye's own evidence (quote it) confirms this is non-POFA, and the date the NTK arrived confirms there can be no keeper liability in this case and the POPLA cannot conclude that the PCN was properly given.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You never know how far you can go until you go too far.0 -
Well done! EVen POPLA struggle to deny an appeal like that, where even the operator has to admit they cant hold you liable...0
