Unfortunately it would appear there's not much that can be done, how much is the fixed penalty??

A mistake on a criminal ticket is not fatal.  You can argue it but it will be corrected and re-issued.  If he forgets to put a seatbelt on should he be driving, it should be second nature so I suspect he is a regular offender who has been caught out.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The course is usually an alternative to points (certainly it is with speeding *ahem*)

If that's the case by far easiest route is to accept the penalty.

Finally, as a general clarion call to anyone that may read this: Aside from the obvious lifesaving benefit of seat belts,  there is a financial incentive too:  If injured in an RTA that isn't your fault and you're not wearing a seat belt, your entitlement to personal injury damages (which you might need to pay for nursing care or private medical treatment) will likely be reduced by 25% for "contributory negligence"
