Unwanted item - am I covered by Consumer Contracts Regulations?

Help needed!
i ordered an electronic item through OnBuy on 4 August with an expected delivery date of 12-14. Needed it for a party. Item arrived on 17 August, the original DPD tracking no. they gave me didn’t exist. I ordered for a specific reason, it arrived late and is too big for any other purpose. I emailed the company asking for a return or exchange for a smaller item in the same range. No reply whatsoever from them. OnBuy said they are
not the seller just the company that finds the best price and I have buyers protection from PayPal, PayPal are saying I am not covered as the goods are not faulty. Now stuck with an item I don’t want!!

Depends where the seller was based? Onbuy is just a platform for retailers not the seller. If outside the Uk you are bound by regulations in the sellers location.

The seller has a website on which is states:
” Returns
Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.”
Just can’t get them to reply to any of my messages.0 -
So they ignore you for 30 days and you get no refund. But their website returns policy may not be the same as their onbuy returns policy.Where are they based?1

Have no idea. There is an email address on their site but again they haven’t responded. I’m hoping my bank can help. I’ve left a review on Trustpilot and there are a few reviews listing the same issue I am having. I should have looked on there before buying!OnBuy have said that it’s an issue between me and the seller so I’m assuming the returns policy is up to the seller so their terms would be the same.0
