It's encouraging that it is at least a popular view that the eligibility criteria for the LISA can be met where a spouse has not jointly purchase or gone through any process to register an interest in the marital home.
The link posted to the conveyancer declaration refreshed my memory that the conveyancer must also declare that "I will only use the Lifetime ISA funds released towards the purchase price of my client’s first residential property, or my client’s first share in a residential property". If said conveyancer understands the couple's circumstances and is willing to make such a declaration, that would give some added reassurance, not to mention an avenue of complaint, should HMRC subsequently take a different view.
